REGULAR MEETING AUGUST 8, 2005 <br />object if the City of South Bend is willing to give up their rights to the alley. Engineering <br />stated that the City of South Bend owns the lot on the other side of the above referred to <br />alley and that the petitioner has a history with the Department of Code Enforcement. <br />Engineering is concerned that allowing this vacation would not allow the City to dispose <br />of the vacant neighboring lot in a way that promotes a better neighborhood. Code <br />Enforcement stated there are violations regarding the petitioner parking on his empty lot <br />without a concrete base. Mr. Inks stated that he did not want to take action on this alley <br />vacation as long as there are existing violations. Mr. Gilot agreed. Mr. Littrell stated that <br />the Board of Public Works should inform the petitioner that the Board should not support <br />this vacation until he repairs his code violations and also presents to the Board of Public <br />works how the vacation will benefit the current City owned lot. Therefore, Mr. Littrell <br />made a motion that the Clerk send a letter to the petitioner addressing these concerns. <br />Mr. Gilot seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY — <br />ALLEY BETWEEN LOTS 330 AND 331 OFF OF FRANKLIN, IN SHIVELY'S <br />ADDITION <br />Mr. Gilot indicated that Mr. Mike Teeter, 1903 Franklin Street, South Bend, Indiana, has <br />submitted a request to vacate the above referred to alley. Mr. Gilot advised that the <br />Board is in receipt of favorable recommendations concerning this Vacation Petition from <br />the Area Plan Commission, Department of Economic Development, Police Department, <br />Fire Department, Sanitation, and the Department of Public Works. Therefore, Mr. <br />Littrell made a motion that the Clerk send a letter to the petitioner addressing these <br />concerns.
