Upon a motion made by Mr. Gilot, seconded by Mr. Littrell, and <br />carried, the updates to the Prevailing Specifications were approved. <br />APPROVE TITLE SHEET — WILLOWGATE TRAILS SUBDIVISION <br />Mr. Gilot advised that the Title Sheet for the above referred to project was being <br />presented at this time for execution. Upon a motion made by Mr. Littrell, seconded by <br />Mr. Inks and carried, the above referred to Title Sheet was approved and signed. <br />RECOMMENDATION - PETITION TO VACATE AN ALLEY — NEXT <br />86 & 87 — ALLEY ON BROOKFIELD STREET IN PRARIE AVENUE HEIGHTS <br />ADDITION <br />Mr. Gilot indicated that Mr. Trinidad Coria, 2004 Prairie Avenue, South Bend, Indiana, <br />has submitted a request to vacate the above referred to alley. Mr. Gilot advised that the <br />Board is in receipt of recommendations concerning this Vacation Petition from the Area <br />Plan Commission, Police Department, Fire Department, Sanitation, and the Department <br />of Public Works. Department of Economic Development maintains an objection, stating <br />that this alley vacation would take access away from three properties. Engineering stated <br />that because of an elevation change and the existence of a substantial wood fence, the <br />other neighboring property cannot easily and effectively benefit from the vacation. The <br />petitioner has already taken possession of the alley and had the use of it as parking space <br />for many years. Engineering would be interested to know the opinion of the Legal <br />Department as to whether there is already adverse possession or whether the petitioner <br />should compensate the neighbor for usurping the neighbor's rights to the property. <br />Therefore, Mr. Gilot made a motion that the Clerk send a letter to the petitioner with a <br />recommendation subject to addressing these concerns. Mr. Littrell seconded the motion <br />which carried. <br />RECOMMENDATION - PETITION TO VACATE AN ALLEY — BETWEEN LOTS 35 <br />& 36 IN THE INDIANA AVENUE ADDITION <br />Mr. Gilot indicated that Mr. Michael D. Ludwig, 615 Indiana Avenue, South Bend, <br />Indiana, has submitted a request to vacate the above referred to alley. Mr. Gilot advised <br />that the Board is in receipt of recommendations concerning this Vacation Petition from <br />the Area Plan Commission, Police Department, Fire Department, Sanitation, and the <br />Department of Public Works. Department of Economic Development maintains an <br />objection to the vacation with no comments. The Fire Department stated that they do not <br />
