<br />(2) MORE OR LESS, 2005 TANDEM AXLE MULTI -USE DUMP TRUCK (2005
<br />CAPITAL BUDGET)
<br />In a memorandum to the Board, Matthew Chlebowski, Central Services, requested
<br />permission to advertise for the receipt of bids for the above referred to equipment.
<br />Therefore, upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the
<br />above request was approved.
<br />APPROVAL OF REQUEST TO SOLICIT FOR PROPOSALS — SECURITY
<br />SERVICES FOR MORRIS PERFORMING ARTS CENTER
<br />Mr. Dennis Andres, Morris Performing Arts Center, requested permission to solicit for
<br />security services proposals for the Morris Performing Arts Center. Upon a motion made
<br />by Mr. Gilot, seconded by Mr. Inks and carried, the request was approved.
<br />APPROVE CHANGE ORDER — 2005 CONCRETE REPAIRS — KANKAKEE
<br />VALLEY CONSTRUCTION — PROJECT NO. 105-033 (LRSA)
<br />Mr. Gilot advised that Ms. Thia Hull-Vawter, Engineering, has submitted Change Order
<br />No. 1 on behalf of Kankakee Valley Construction, Post Office Box 1471, LaPorte,
<br />Indiana, indicating that the Contract amount be increased $6,750.00 for a new Contract
<br />sum including this Change Order in the amount of $212,504.00. Upon a motion made by
<br />Mr. Inks, seconded by Mr. Littrell, and carried, the Change Order was approved.
<br />APPROVE FINAL CHANGE ORDER AND PROJECT COMPLETION AFFIDAVIT —
<br />BEALE STREET SANITARY SEWER REPAIR — YOUNGS EXCAVATING —
<br />PROJECT NO. 105-052 (SEWAGE WORKS)
<br />Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted the Final Change Order
<br />on behalf of Youngs Excavating, Post Office Box 2760, South Bend, Indiana, indicating
<br />that the contract amount be increased by $38,189.50 for a new contract sum including
<br />this Change Order in the amount of $76,607.00. In April 2005, it was determined that the
<br />sanitary sewers at Beale and Sherman had collapsed and had the potential to cause
<br />serious back-ups to the homes in the area. On April 29, 2005, the Board of Public Works
<br />opened emergency quotes and granted emergency powers to the Engineering Department
<br />to proceed with the repair. Youngs Excavating was the lowest responsive and
<br />responsible bidder and was awarded the project. The original scope of the project was to
<br />repair the collapsed sanitary sewers at the intersection of Beale and Sherman. This
<br />consisted of excavating around the manhole at the intersection, the removal and
<br />replacement of approximately 50 feet of 20 inch sewer on Sherman, the removal and
<br />replacement of approximately 50 feet of 12 inch sewer on Beale, bypass pumping,
<br />placement of backfill material, and the placement of aggregate sub -base. The original
<br />base quote from Youngs excavating was $38,417.50. After the excavation was
<br />completed for the original area of the repair, Youngs Excavating found an additional
<br />problem with the 20 inch sewer that ran north on Sherman from the intersection at Beale.
<br />The original 20 inch sanitary sewer on Sherman had been set on a grade reverse of the
<br />actual flow of the sewer. The discovery of this previously unknown problem along with
<br />the known collapsed portion created a significant back-up in the Sherman sewer and
<br />prevented the sewer from reaching its proper capacity. It was also determined that the
<br />original repair would not fix the entire back up problem without correcting the mislaid
<br />sewer. Youngs Excavating was then asked, under the emergency powers granted by the
<br />Board of Public Works, to proceed with the removal of approximately 300 feet of the
<br />existing 20 inch sewer that was laid at the incorrect grade and replace it with a new sewer
<br />that had a proper slope. The new length of sewer was approximately six times the original
<br />amount in the quote. This also increased the excavation by six times and extended the
<br />project time by 2 weeks. The project has been completed, and the sewer is operating
<br />properly. Because it was not reasonably foreseeable that the existing sanitary sewer on
<br />Sherman Avenue was laid at an incorrect grade, this resulted in the additional expenses.
<br />Due to the change in the scope of the contract, the cost of the project increased from
<br />$38,417.50 to $76,607.00. There were no other changes to the contract. Since there was
<br />neither actual nor constructive notice of the necessity for this additional work, this
<br />Change Order can be and is well below and in compliance with the 20% rule when the
