`) ;ULAR MEETING <br />FEBRUARY 14, 2005 <br />APPROVAL OF LICENSE APPLICATION FOR MASSAGE ESTABLISHMENT — <br />3601 JEFFERSON —THERAPEUTIC TOUCH <br />Mr. Littrell that the Board is in receipt of favorable recommendations from the Fire <br />Department, Police Department, Building Commissioner and the City Attorney's Office <br />or a License Application for a Massage Establishment at 3601 East Jefferson. Upon a <br />motion made by Mr. Littrell, seconded by Ms. Kendall and carried, the License <br />Application was approved. <br />APPROVAL OF RECOMMENDATION — TO CLOSE STREET — MICHIGAN FROM <br />PARKING LOT NORTH OF MORRIS CIVIC TO COLFAX — "FRIDAYS BY THE <br />FOUNTAIN" <br />Mr. Littrell stated that favorable recommendations have been received by Traffic and <br />Lighting, Police Department and the City Attorney's office, in reference to a request as <br />submitted by Ms. Sara Ermeti, Morris Performing Arts Center, to conduct the above <br />referred to events on June 3, 10 and 24; July 8 and 22; and August 5 and 19, 2005. Upon <br />a motion made by Mr. Littrell, seconded by Ms. Kendall and carried, the <br />recommendation was approved. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY — <br />FIRST EAST/WEST ALLEY EAST OF TAYLOR, WEST OF WILLIAM <br />Mr. Littrell indicated that Ms. Connie Tooley, 514 West LaSalle, South Bend, Indiana, <br />has submitted a request to vacate the above referred to alley. Mr. Littrell advised that the <br />Board is in receipt of recommendations concerning this Vacation Petition from the Area <br />Plan Commission, Police Department, Fire Department, Sanitation, Department of <br />Economic Development and the Department of Public Works. Engineering <br />recommended unfavorably. This eliminates access to the rear of two lots facing <br />Lincolnway West that have common ownership, which are Key Nos. 18-1019-0775 and <br />0774. The vacation would seriously hinder enjoyment of that property. Area Plan also <br />recommended unfavorably. It appears that a property along Lincolnway West has a <br />parking lot that only has access from this alley. Furthermore, the petitioner does not <br />appear to be an adjacent property owner. Therefore, Mr. Littrell made a motion that the <br />Clerk send a letter to the petitioner addressing these concerns. Ms. Kendall seconded the <br />motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY — <br />FIRST NORTH/South ALLEY EAST OF TAYLOR, WEST OF WILLIAM <br />Mr. Littrell indicated that Ms. Connie Tooley, 514 West LaSalle, South Bend, Indiana, <br />has submitted a request to vacate the above referred to alley. Mr. Littrell advised that the <br />Board is in receipt of recommendations concerning this Vacation Petition from the Area <br />Plan Commission, Police Department, Fire Department, Sanitation, Department of <br />Economic Development and the Department of Public Works. If this alley is vacated, it <br />be done so subject to any utility easements that are necessary. Therefore, Mr. Littrell <br />made a motion that the Clerk send a letter to the petitioner addressing these concerns. <br />Ms. Kendall seconded the motion which carried. <br />REVOKABLE PERMIT — INSTALLATION OF AWNING — 1527 LINCOLNWAY <br />WEST — OXIAN USED FURNITURE <br />Mr. Littrell stated a Revocable Permit has been received for the purpose of installing an <br />awning at 1527 Lincolnway West. Mr. Littrell noted that there is not an encroachment in <br />the right-of-way, as the awning will be installed on home, therefore, the Board does not <br />need to act upon this. <br />TABLE REQUEST — TO CONDUCT "RIDE FOR KIDS" — PEDIATRIC BRAIN <br />TUMOR FOUNDATION <br />Mr. Littrell stated that an unfavorable recommendation has been received by the Police <br />Department, in reference to a request as submitted by Mr. Mark Muhlenfeld, Pediatric <br />Brain Tumor Foundation, 302 Ridgefield Court, Asheville, North Carolina, to conduct <br />the above referred to event on July 10, 2005, from 7:00 a.m. to 12:00 p.m. on the <br />designated route as submitted. There is a concern of the large number of motorcycles in <br />a procession through a residential area on a Sunday morning. Upon a motion made by <br />Mr. Littrell, seconded by Ms. Kendall and carried, the request was tabled, pending further <br />discussions with the Police Department for an alternate route. <br />1 <br />1 <br />1 <br />
