0031 <br />PUBLIC AGENDA SESSION FEBRUARY 10, 2005 <br />- Lease Purchase Agreement — Trash Containers/Trash Trucks <br />Mr. Jack Dillon, Environmental Services, stated that this Lease Agreement is for <br />the purchase of trash containers and trash trucks. The funding comes from Fund <br />611. <br />- Proposal Groundwater and Methane Gas Reporting <br />Mr. Ken Zmudzinski, Environmental Services, stated this Proposal with Weaver <br />Boos Consultants, LLC, will provide sampling of methane in underground water <br />sources in Fredrickson Park. He stated the funding is still unknown. Mr. Tom <br />Bodnar stated that he would like the Arbitration Clause in Section 11 of this <br />Proposal stricken prior to approval by the Board. <br />- Proposal — Organic Resources Needs Assessment and Class A Bio-Solids Technology <br />Review <br />Mr. Ken Zmudzinski, Environmental Services, stated this Proposal with Triad <br />Engineering, Inc., will provide bio-solids testing to ensure compliance. This <br />Proposal will also help evaluate new technologies for bio-solid give away after it <br />is processed. Mr. Zmudzinski said this review is being used as a proactive step <br />toward the new compatibility rule which may be passed soon. Mr. Bodnar stated <br />that he would like the Limitation of Liability in Article 13 of the Terms and <br />Conditions of the Proposal stricken prior to approval by the Board because it <br />states that the Proposal's jurisdiction resides in the state and federal courts located <br />in Marion County, Indiana, instead of St. Joseph County, Indiana. <br />- Proposal — Statistical Analysis of Groundwater Data <br />Mr. Ken Zmudzinski, Environmental Services, stated that this Proposal is a ten <br />(10) year Proposal from ATC Associates, Inc., who will provide a statistical <br />analysis of groundwater data of the bio-solids landfill for 2005-2006 and also <br />underground water maps. This analysis is done bi-yearly so this Proposal will <br />cover analysis done until 2009. Mr. Bodnar stated that he would like the sentence <br />in Section 1 of the General Terms and Conditions containing the wording <br />regarding a 1 1/2$% interest charge for past due payments stricken prior to <br />approval by the Board. <br />- Proposal — Review of Statistical Analysis Procedures — Closed Bio-Solids Landfill <br />Mr. Tom Bodnar stated that he would like the sentence in Section 1 of the General <br />Terms and Conditions containing the wording regarding a 1 %2% interest charge <br />for past due payments stricken prior to approval by the Board. <br />- Proposal — Drainage Study — Kensington Farms/Crest Manor <br />Mr. Jason Durr, Engineering, stated that through this Proposal, The Troyer Group <br />will provide a drainage study of the Kensington Farms and Crest Manor <br />neighborhoods to develop alternatives to alleviate drainage problems. Mr. Durr <br />stated that the neighborhood residents are currently using the retention ponds for <br />lakes and would like to find a way to keep some of the drainage ditches as lakes <br />and improve storm water drainage through this study. <br />- Encroachment — Installation of Awning —1527 Lincolnway West <br />Mr. Carl Littrell, Engineering, stated that the awning to be installed will not <br />encroach into the public right-of-way because it is for a structure set back from <br />the property line. No action is required from Board of Works. <br />- Alley Vacation — First East/West Alley East of Taylor <br />Mr. Carl Littrell, Engineering, stated that the Board may not be able to approve <br />the vacation of this alley because it will not allow access to lots facing <br />Lincolnway West that have common ownership of the alley. <br />To Conduct "Ride for Kids" — Pediatric Brain Tumor Foundation <br />Mr. Littrell stated that there are no representatives from the Pediatric Brain Tumor <br />Foundation in the South Bend area. He is unfamiliar with the sponsors and it is <br />their first event in South Bend. Mr. Littrell would like to perform a background <br />check prior to approving this event. Secondly, Mr. Littrell stated that the sponsors <br />would have to contact the Police Department for assistance and the Parks <br />Department to obtain permission to use Pinhook Park separately after the Board's <br />approval. <br />
