E <br />4) . A Variance from the requirement of providing perimeter trees at a <br />minimum rate of one (1) over -story deciduous tree every forty (40) feet <br />along the North, South and West property lines to trees shown and to <br />providing no perimeter trees along the East property line. <br />5) . A Variance from the maximum allowed four (4) stall garage structure <br />to a maximum of an eight (8) stall garage structure as shown. <br />6). A Variance from the requirement of having only one (1) Primary Use <br />to being allowed to have a maximum of two (2) Primary uses until such <br />time as the original Primary use structure is razed. <br />7). A Variance to be allowed to have a maximum 4 ft. high, 32 sq.ft. <br />monument sign as shown instead of the maximum allowed 16 sq.ft. <br />PARCEL "A" (214 OLIVE STREET) SPECIAL EXCEPTION REQUEST: <br />1) . Approval of a Special Exception Use as allowed under Section 21- <br />02.02 (a)(2)(B) Government Use, of the City of South Bend Zoning <br />Ordinance to allow for a Fire Station on property zoned "SF2" Single <br />Family and Two Family District. <br />The Petitioner is the owner of the real estate parcel shown on the <br />attached site plan and as shown in the records of the St. Joseph County, <br />Indiana Auditor's office. The Petition property presently has a Zoning <br />classification of "SF2" Single Family and Two Family District. <br />The property is and has been over the past few decades used for a <br />Fire Station. The existing Fire Station is at the end of its useful <br />life, due to its age. This old Fire Station is now ready to be replaced <br />with an updated functional and sustainable facility. <br />Representatives for the City met with the Building Department staff <br />to discuss the issues associated with the replacement of the existing <br />Fire Station with a new facility. Based on those discussions it was <br />determined that in order to build a new Fire Station as shown on the <br />attached site plan, two procedures would need to be followed and <br />approved. Due to the existing zoning being "SF2" Single Family and Two <br />Family, the new Fire Station would be required to have a Special <br />Exception approved to allow for its' construction. Even though a Fire <br />Station presently exists on the property, it is presently considered a <br />legal non - conforming use. Once that facility is removed that status is <br />null and void and the proposed new Fire Station is required to comply <br />with all current zoning standards. Also based on the proposed site plan, <br />several variances are required to be approved to allow for the site to <br />be developed shown. <br />Described below are the Variances and Special Exception requests for <br />the Petition site. More specifically, the following Variances are being <br />requested: <br />The first variance request is to be allowed to encroach into the 25 <br />ft. Front -yard area along Olive Street and Orange Street to a minimum of <br />20 feet to allow for a proposed recreational walking track as shown. The <br />
