RE: An Ordinance of the Common Council of the City of South Bend, Indiana, Authorizing a Direct Loan to the Developer of an Economic Development Facility (Heartwood Commons Project) and Approving Other Matters in Connection Therewith. Dear Chairperson White: Please find the attached bill, which is an ordinance authorizing a economic development loan in an amount not to exceed $1. 7 million to support the construction of the Heartwood Commons affordable housing development at 2018-2020 South Main Street . The project will consist of a multifamily apartment building containing fifty (50) affordable housing units. The development received an allocation of Low-Income Housing Tax Credits from the Indiana Housing and Community Development Authority and will provide long-term affordable housing opportunities for South Bend residents. The project is anticipated to result in approximately $16.7 million in total development costs, including no less than $15 million in private investment by the developer. The Common Council previously approved a Tax Abatement in support of the project in 2025. The loan would be funded utilizing Ta x Increment Financing revenues from the South Side Development Area Allocation Fund and would be administered as a draw-based loan. The loan requires approval by the Common Council, the South Bend Economic Development Commission, and the South Bend Redevelopment Commission before funds may be disbursed. The loan would be forgivable upon substantial completion of the project in accordance with the financing and development agreements approved by the City. If the project is not completed as required, the loan would become repayable pursuant to the terms of the financing documents. 215 S. On March 27, 2023, the Common Council adopted Resolution No. 5000-23, which confirmed a six-year real property tax deduction for The Robert Henry Corporation for the construction of a new truck maintenance facility and offices at the addresses denoted above. In May 2025, the company submitted its Form CF-1/RE to both the St. Joseph County Auditor and the Department of Community Investment, but it inadvertently failed to timely and properly file Form 322/RE with the St. Joseph County Auditor. As a result of this filing error, the company did not receive the real property tax deduction for taxes due and payable in 2026. The Robert Henry Corporation is requesting that the Common Council waive noncompliance associated with the filing of tax abatement forms for taxes due and payable in 2026. Had the company properly filed Form 322/RE, it would have received the benefits of the tax abatement confirmed by the Common Council. The Department of Community Investment requests that the attached resolution be referred to the Community Investment Committee for an advisory recommendation and then heard at the Common Council meeting to be held on October 26, 2026. A representative from The Robert Henry Corporation will be present at the meetings. Should you require additional information, please contact me at (574) 235-5838. Filed in Clerk's Office Oct 6, 2026 Bianca Tirado City Clerk, South Bend, IN Please accept this ordinance to vacate a portion of the street right-of-way as shown in the attached diagram. The vacation would include all right-of-way for Chapin St. between W. Calvert St. to the south and Bruce St. to the north. This roadway is not a central travel path for the neighboring streets so there would be no anticipa ted traffic impacts from this vacation. All public utilities currently located within this portion of the vacated area that will remain will be granted an easement for future access. Coordination with the utility companies will be done to determine which utilities are designated to remain and those which can be relocated. Our Lady of Hungary Parish is excited about the future development of this area. Formally vacating this right-of-way will allow for more unified parcel between the church and the school buildings while also allowing for future play spaces for the children. Additiona lly, this will help provide a more cohesive parking layout for the church which will allow for safer traffic patterns during church events. We respectfully request approval to vacate the right-of-way as shown in the attached diagram for the reasons discussed above. Dr. Martin Luther King Jr., Blvd Suite 300 South Bend, Indiana 46601 October 21, 2026 Filed in Clerk's Office Oct 21, 2026 Bianca Tirado City Clerk, South Bend, IN Re: AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 13, ARTICLE 12 SECTIONS 13-155 THROUGH AND INCLUDING 13-164 ESTABLISHING CHRONIC PROBLEM PROPERTY REGULATIONS Dear Council Members: As you know, die Residen tial Neighborhoods Committee has been involved in an ongoing process to update the City's Quality of Life Ordinances along with the City Legal Department. These proposed ordinances amend and update the current ordinances addressing Chronic Problem Properties. The City has enacted ordinances establishing regulations for Chronic Problem Properties in order to limit excessive calls for service to problem areas, trouble spots, or high-activity areas. The goal of such regulations is to avoid placing an undue burden on public safety resources which may result in decreased public safety services being provided to oilier areas of the City. Many of the existing ordinances have been in place for several years. The purposes of these amendments include simplifying the administrative processes for addressing Chronic Problem Properties; clarifying die processes to property owners; and adding efficiencies to enhance enforcement of regulations addressing Chronic Problem Properties. The amendments will also align die ordinances wiili existing law. I ask for this proposed ordinance to be placed on the agenda for first reading and assignment to the Residential Neighborhoods Committee at the October 26, 2026, Council meeting and then to the Committee for second reading, public hearing and iliird reading at the Council's November 9, 2026.
