As the resolution sets out, the Order prohibits City departments, employees, and appointees from entering into, approving, amending, renewing, or extending data center agreements that would restrict transparency or public disclosure beyond what applicable law already permits. It further requires that data center project agreements affirm their status as public records under the Indiana Access to Public Records Act, subject only to the protections that state and federal law already provide. I believe this Order reflects a principle this Council should stand behind: that agreements affecting public assets, public funds, and public services; including those involving data center projects, should be conducted with the transparency our residents are entitled to expect. I will be available to discuss this bill under the Personnel and Finance Committee and at the full Council meeting on Monday, September 28, 2026. Thank you for your attention to this matter. RE: An Ordinance of the Common Council of the City of South Bend, Indiana, Authorizing a Direct Loan to the Developer of an Economic Development Facility (Heartwood Commons Project) and Approving Other Matters in Connection Therewith. Dear Chairperson White: Please find the attached bill, which is an ordinance authorizing a economic development loan in an amount not to exceed $1. 7 million to support the construction of the Heartwood Commons affordable housing development at 2018-2020 South Main Street . The project will consist of a multifamily apartment building containing fifty (50) affordable housing units. The development received an allocation of Low-Income Housing Tax Credits from the Indiana Housing and Community Development Authority and will provide long-term affordable housing opportunities for South Bend residents. The project is anticipated to result in approximately $16.7 million in total development costs, including no less than $15 million in private investment by the developer. The Common Council previously approved a Tax Abatement in support of the project in 2025. The loan would be funded utilizing Ta x Increment Financing revenues from the South Side Development Area Allocation Fund and would be administered as a draw-based loan. The loan requires approval by the Common Council, the South Bend Economic Development Commission, and the South Bend Redevelopment Commission before funds may be disbursed. The loan would be forgivable upon substantial completion of the project in accordance with the financing and development agreements approved by the City. If the project is not completed as required, the loan would become repayable pursuant to the terms of the financing documents. 215 S.
