HomeMy WebLinkAbout09082026 BPW Meeting Minutes - FinalAGENDA REVIEW SESSION SEPTEMBER 3, 2026 198
The Agenda Review Session of the Board of Public Works was convened at 10:31 a.m. on
September 3, 2026, by Board President Elizabeth A. Maradik, Vice President Joseph
Molnar, and Board Members Murray Miller, Breana Micou, Abigail Magas and Board
Attorney Michael Schmidt present. The Board of Public Works Clerk, Hillary R. Horvath,
presented the Board with a proposed agenda of items presented by the public and by City
Staff.
Board members discussed the following item(s) from the agenda.
Caitlin Wyant, Engineering, presented to the Board item 5A: The Point at Riverwalk –
Exterior Doors & Siding – Project No. 124-069I. She shared that although the lowest
bidder for the project was ABC Supply Co. Inc., the company did not include a signed and
notarized affidavit with their bid. Accordingly, the contract will be awarded to Big C
Lumber, the second lowest bidder for the project, with a difference in price of roughly
$9,000.
Jenny Guard, Engineering, presented to the Board items 6A: SRTS Muessel Primary/Holy
Cross Schools – Project No. 122-006 and 6B: SRTS Kennedy Academy – Project No. 123-
017.She shared that both Safe Route to School projects did not originally include prices of
pavement removal, and the change orders listed in the agenda indicate those prices.
Pavement removal for Muessel Primary/Holy Cross Schools adds a 0.9% increase of
$15,279 and twenty-one (21) days to the project. Pavement removal for Kennedy
Academy adds a 0.5% increase of $8,655.15 and thirty-five (35) days to the project.
Zach Hurst, Engineering, presented to the Board item 9H: Amendment No. 2 to CMc
Contract – F. A. Wilhelm – Remainder of the Guaranteed Maximum Price for the New
Parking Garage, for the Madison Lifestyle District – Project No. 123-074. He shared that
although they are waiting on paperwork from F. A. Wilhelm, the contract is planned to be
for $7,900,000, with $6,800,000 allocated for early foundation work and $1,100,000 for
the change order related to the water main. Amendment No. 2 has a value of $26,789,000,
with a project total of $34,927,000. Of that total, $30,500,000 will go toward the parking
garage and apartment podium, over $500,000 will go toward the water main work, and
$3,900,000 will be paid on behalf of development partner Great Lakes Capital at the
request of Mayor Mueller. The project was unable to reach MWBE goals and will be
seeking a waiver alongside a compilation of good faith documents.
Brian Killen, Zoning, presented to the Board item 2A: Petition of Voluntary Disannexation
–3939 Portage Rd. – John Rosetto. Killen shared that 3939 Portage Rd. is a single lot on
the boundary between the county and city, meeting contiguity requirements. The
property owner’s primary concerns were related to address finding, stating that mail
delivery, trash pickup, and police routing had all had difficulties finding his house.
Reflecting on previous disannexation cases, the Legal Department determined that the
property owner’s concerns did not constitute substantial cause. Disannexing the property
may also have future negative impacts. If the property’s water or septic were to ever fail,
the County health department would likely require the property owner to connect to City
utilities due to proximity, requiring a reannexation of the property. The Board sought
direction from Board Attorney on how to process a disannexation. It was determined that
after a public hearing, the Board will have the final decision to approve or deny without
any coordination with the Common Council. Killen reminded the Board that Zoning had
given the disannexation unfavorable recommendations, requests to deny, and that the
property owner is aware of the unfavorable recommendation in advance of the
September 8, 2026, meeting.
Board Member Murray Miller inquired about item 9C: Ratify Emergency Work – 4T Door
Systems – Replacement of Overhead Door at Public Works Service Center that was
Damaged by an Outside Vendor Truck. Board Attorney Michael Schmidt explained that a
vendor truck had recently hit the Public Works Service Center garage while in a rush. The
garage door had been damaged and needed to be fully replaced. Although they will be
seeking insurance to cover the cost, Schmidt requested an emergency work order to
replace the door immediately.

REGULAR MEETING SEPTEMBER 8, 2026
The Regular Meeting of the Board of Public Works was convened at 9:32 a.m. on
Tuesday, September 8, 2026, by Board President Elizabeth A. Maradik in the 4th Floor
Public Meeting Room, Council Chambers of the City Hall Building, 215 S. Martin Luther
King Jr. Blvd., Suite 400., South Bend, Indiana. The meeting was also streamed live to the
public via Microsoft Teams. Board Clerk Hillary R. Horvath confirmed the presence
of Board President Elizabeth A. Maradik, Vice President Joseph Molnar, and Board
Members Murray Miller, Breana Micou, Abigail Magas and Board Attorney Michael
Schmidt, with a roll call. President Maradik reminded virtual attendees to mute their
microphones and turn off their cameras when not speaking, and to save their questions
and comments for the Privilege of the Floor.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by VP Molnar, seconded by Mr. Miller and carried by roll call,
the minutes for the Agenda Review Session and Regular Meetings of the Board held on
August 20, 2026, and August 25, 2026, were approved.
PUBLIC HEARING – PETITION OF VOLUNTARY DISANNEXATION – 3939 PORTAGE
ROAD
President Maradik advised that this was the date set for the Board’s Public
Hearing concerning a petition of voluntary disannexation. It was noted with
unfavorable recommendations from City staff.
John Rosetto, the property owner of the address in question, 3939 Portage Rd,
appeared before the Board to explain his reasoning for the disannexation. Mr. Rosetto
claimed that his property, which lays on the boundary between the county and the
city, receives no services from either the county or the city. Various addressing
softwares cannot locate his city address of 3939 Portage Rd, and so he often must use
his former county address of 52423 Portage Rd to receive any services. According to Mr.
Rosetto, the South Bend Police Department cannot locate his house, the United States
Postal Service fails to deliver mail to his address, and online GPS services cannot find his
house either. Due to confusion about whether his address is county or city, he claims the
City often refuses to collect his trash or
September 22, 2026
REGULAR MEETING SEPTEMBER 8, 2026 200
leaf pickup. Due to conflicting information regarding his address, he wishes to disannex his
property from the City and return to St. Joseph County services.
President Maradik informed Mr. Rosetto that rather than an issue with annexation, his
concerns seemed to stem from addressing software, which could be reviewed for accuracy
of information and possibly updated if incorrect. Mr. Rosetto claimed that he had lived at
the property since 2013, did not consent to its annexation, and was not informed that it had
been annexed until 2019. Staff present at the meeting clarified that the property had been
annexed by the City of South Bend in 2004, nine years before Mr. Rosetto purchased the
property. VP Molnar informed Rosetto that City staff had reviewed his case and had given
it unfavorable recommendations, and that it would be nonstandard for the Board to vote in
opposition to staff recommendations. President Maradik suggested that Mr. Rosetto stay
after the meeting to discuss with Public Works staff how to approach GPS and GIS
addressing concerns. There being no further discussion concerning this matter, the Public
Hearing was closed. Therefore, upon a motion made by VP Molnar, seconded by Mr. Miller
and carried by roll call, the request for disannexation was denied.
