12. Substitutes and "or -equal": DELETED <br />13. Inspections and Tests: The Engineer shall provide the following services in relationship to <br />review of the work in progress, inspection and tests: <br />a. Conduct on -site inspections for the Owner of the work in progress as a basis for <br />determining that the project is proceeding in accordance with the Contract Documents. <br />The Engineer shall neither have control over or charge of, nor be responsible for, the <br />construction means, methods, techniques, sequences or procedures, or for safety <br />precautions and programs in connection with the Work, since these are solely the <br />Contractor's rights and responsibilities under the Contract Documents. <br />b. Engineer shall report to the Owner known deviation from the Contract Documents and <br />from the most recent construction schedule submitted by the Contractor. However, <br />Engineer shall not be responsible for the Contractor's failure to perform the Work in <br />accordance with the requirements of the Contract Documents. Engineer shall not have <br />control over or charge of and shall not be responsible for acts or omissions of the <br />Contractor, Subcontractors, or their agents or employees, or of any other persons or <br />entities performing portions of the Work. <br />c. Review testing procedures of Contractor's Independent Testing Agency for accuracy <br />and completeness. <br />d. Accompany visiting inspectors, representing Local, State or Federal Agencies having <br />jurisdiction over the project, and report details of such inspection to the Owner. <br />14. Disagreements between Owner and Contractor: DELETED <br />15. Applications for Payment: Review progress estimates for periodic partial payments to the <br />Contractor and deliver to the Owner for review and processing. The payments to the <br />Contractor will be based on estimates of the value of work performed and materials <br />complete in place in accordance with the contract. <br />16. Contractor's Completion Documents: DELETED <br />17. Substantial Completion: DELETED <br />18. Additional Tasks: DELETED <br />19. Final Notice of Acceptability of the Work: DELETED <br />B. Duration of Construction Phase: The Construction Phase will commence with the execution of <br />the Construction Contract for the Project or any part thereof and will terminate upon final closeout <br />of the project, which will be one (1) week after the October 1, 2016 completion date set forth in <br />the Contract Documents. If the Project involves more than one prime contract as indicated in <br />Paragraph A1.03.C, then Construction Phase services may be rendered at different times in respect <br />to the separate contracts.
