REGULAR MEETING MAY 11, 2009 <br /> <br /> <br /> <br />th <br />Christa Nayder, Staff Planner, Area Plan Commission, 11 Floor County-City Building, <br />227 W. Jefferson Blvd., South Bend, Indiana, presented the report from the Commission. <br /> <br />Ms. Nayder advised the petitioner is requesting a zone change from MU Mixed Use <br />District to SF2 Single Family and Two Family District to allow existing single family <br />home. On site is an existing single family home. To the north is a single family home <br />zoned MU Mixed Use District. To the east across Taylor Street is the parking lot for an <br />office building. To the south is a vacant lot owned by the petitioner. To the west are <br />apartments zoned MF1 Urban Corridor Multifamily District. The SF2 District is <br />established to protect, promote and maintain the development of single family dwellings <br />and two family dwellings in the urban core of the City of South Bend as well as to <br />provide for limited public and institutional uses that are compatible with an urban <br />residential neighborhood. The availability of public facilities (e.g., public water, public <br />sanitary sewer, storm sewer, natural gas, electricity, telephone, etc.) is required for <br />development within this district. No site plan is required. There is an existing house. <br />Taylor Street is two lanes. There is no alley access. She noted that City Plan, South Bend <br />Comprehensive Plan, November 2006 H 2.6 Encourage homeowners to maintain their <br />homes. The addition of a garage supports the continued use of the site as a single family <br />home. The future land use plan shows this area as Mixed Use and Multi-family. There is <br />a small apartment building at northwest corner of Taylor Street and Washington Street. <br />Just north of that is a janitorial business. The rest of the block north to Colfax Street <br />consists of single family homes. The northeast corner of Taylor Street and Washington <br />Street is an office building and parking lot. At the southeast corner of Taylor and Colfax <br />is a printing business. The general uses within several blocks are a mixture of single <br />family, multi-family, and office. The most desirable use is to maintain the continued use <br />of the existing house as a residence. The surrounding property values should not be <br />affected. It is responsible development and growth to allow a single family home to <br />continue to be used as such. Based on information available prior to the public hearing, <br />the staff recommends that the petition be sent to the Common council with a favorable <br />recommendation. It is appropriate at this time to allow the continued and expanded use of <br />this site as a residence. <br /> <br /> <br />Donald Irminger, 117 N. Taylor, South Bend, South Bend, Indiana, stated that he went to <br />start to build a garage and found out that the property was zoned Mixed Use. He stated <br />that he has lived there for over 22 years. He stated that he was initially told that the <br />zoning of Mixed Use prohibited such a thing and now he understands that that is not <br />actually true. In response to that he applied for this rezoning. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this bill. Councilmember Varner seconded <br />the motion which carried by a voice vote of eight (8) ayes. <br /> <br /> <br />BILL NO. 21-09 PUBLIC HEARING ON A BILL <br />AMENDING THE ZONING ORDINANCE <br />FOR PROPERTY LOCATED AT 244 <br />SOUTH OLIVE STREET, SOUTH BEND, <br />IN 46619, COUNCILMANIC DISTRICT <br />ND <br />2 DISTRICT IN THE CITY OF SOUTH <br />BEND, INDIANA <br /> <br /> <br />Councilmember Dieter made a motion to hear the substitute version of this bill. <br />Councilmember White seconded the motion which carried by a voice vote of eight (8) <br />ayes. <br /> <br /> 5 <br /> <br />
