Mr. Spier noted that the 2 substitute version states that approval <br />is subject to the voluntary agreement of Petitioner with the following <br />conditions/limitations, specifically that such approval shall (a) only apply from and after <br />the date that Petitioner records a Declaration regarding limitation on special exception (in <br />the form attached), (b) only extend to each unit comprising the subject property during <br />such periods that the unit is owned by the Chicago Province of the Society of Jesus <br />(“Province”) for occupancy by their Jesuits community, and (c) automatically terminate <br />and be of no further force of effect upon the transfer to title to the unit comprising the <br />subject property by the Province to any other owner; and the recording of a commitment. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />nd <br />opposition to this Resolution, Councilmember Kirsits made a motion to adopt this 2 <br />Substitute Resolution.
