Councilmember Oliver Davis seconded the motion which carried by a voice <br /> vote of eight (8) ayes. <br /> BILL NO. 63-13 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA AMENDING CHAPTER 17 OF <br /> THE SOUTH BEND MUNICIPAL CODE TO <br /> REINSTATE ARTICLE 2, SECTION 17-27.1 <br /> HAULED SEPTIC WASTE <br /> Councilmember Oliver Davis, Chairperson, Public Works and Property Vacation Committee, <br /> reported that this committee met on this bill this afternoon and voted to send it to the full Council <br /> with a favorable recommendation. <br /> Eric Horvath, Director, Public Works, 13th Floor County-City Building,227 W. Jefferson Blvd., <br /> South Bend, Indiana,made the presentation for this bill. <br /> Mr. Horvath advised that this bill would reinstate Section 17-27.1 as previously adopted in 2004. <br /> That Section addresses regulations for hauled residential septic tank and other liquid waste, and <br /> it was inadvertently deleted from the South Bend Municipal Code when Chapter 17 Article 2 <br /> was substantially amended in 2011 to comply with the Clean Water Act under Ordinance No. <br /> 10095-11. He stated that because regulation for the hauling of residential septic tank and similar <br /> liquid waste to the South Bend Wastewater Treatment Plant, and the assessment of fees for such <br /> hauling is important to the Plant operation, it is necessary to reinstate this into the code. <br /> This being the time heretofore set for the Public Hearing on the above bill, proponents and <br /> opponents were given an opportunity to be heard. <br /> There being no one present wishing to speak to the Council either in favor of or in opposition to <br /> this bill, Councilmember Dieter made a motion for favorable recommendation to full Council <br /> concerning this bill.
