Responsible Animal and Pet Ownership Care and Control Regulation Ordinance <br />Page 24 <br />(c) It shall be unlawful for a person, having placed a lawful trap, snare or similar device, to <br />capture wildlife, to fail to inspect and empty it at least once during every twenty -four- <br />hour period. <br />(d) It shall be unlawful for a person to fail to inspect and care for the captured free - roaming <br />cat a minimum of every two (2) hours to ensure the safety of the cat(s), having placed a <br />lawful trap, snare or similar device, to capture free - roaming cats for the purpose of trap, <br />neuter, return or other medical care. <br />(e) It shall be unlawful for a person to remove an animal from any trap not on the person's <br />property, unless such person has the express permission of the property's owner to do so. <br />(f) The Division of Animal Care and Control, in order to encourage the stabilization of the <br />free - roaming cat population may: <br />1. Trap any free - roaming cat in a humane manner; <br />2. Have the cat surgically sterilized, ear - tipped, and vaccinated against rabies by a <br />licensed veterinarian; and <br />Release the cat to the Division of Animal Care and Control for adoption or other <br />disposition in accordance with law, or to a colony caretaker who will maintain the <br />cat as part of a managed colony of community cats. Cat must be returned as close <br />as possible to its location of capture unless illness or injury presents imminent <br />danger to the animal. <br />(g) Traps discovered by the Division of Animal Care and Control to have been unlawfully set <br />may be seized. <br />Sec. 5 -33 Public Nuisance Animal Prohibited. <br />No person shall own or harbor a public nuisance as defined in this Chapter. <br />Sec. 5 -34 Animals as Prizes or Inducements Prohibited. <br />(a) No person shall sell, offer for sale, trade, barter, or give away any live animal as a prize. <br />(b) No animal shall be used as an inducement to enter, a place of amusement or any business <br />establishment other than establishments whose primary business is selling animals except <br />for domesticated pets. <br />(c) Governmental agencies or animal welfare organizations maintaining a 501C3 providing <br />health, safety, or adoption promotions will be exempt from the provisions of subsection <br />(a) as described above. Any events as listed in (a) will require necessary permits and <br />inspection. <br />
