No. <br />10241, § II, 07- 08- 2013)20 <br />Sec. 5 -11 Compliance Required; Penalties. <br />(a) It shall be unlawful for any person to keep or maintain an apiary, hive, or colony in the <br />City which is not in compliance with this Article. <br />(b) Any person violating any of the provisions of this Article shall be issued a citation by the <br />Department of Code Enforcement which provides for a fine of seventy -five dollars <br />($75.00) per violation payable through the Ordinance Violations. <br />(c) Each violation shall constitute a separate and distinct offense. Every day any violation of <br />this Article shall continue shall constitute a separate offense. <br />(d) Any apiary, hive or colony which threatens public health or safety; or creates a public <br />nuisance; or which has been abandoned is unlawful. The City is authorized to take all <br />reasonable action including removal and/or destruction of any apiary, hive or colony <br />which is deemed necessary. (Ord. Animal Care Rules and Re ulations 21 <br />See. 5 -15 Adequate Shelter, Food and Water to be Provided 22 <br />Every owner or keeper of an animal kept in the city shall see that such animal: <br />(a) Is kept in a clean, sanitary and healthy manner and is not confined so as to be forced to <br />stand, sit or lie in its own excrement; the person(s) responsible for animal(s) shall <br />regularly and as often as necessary to prevent odor or health and sanitation problems, <br />maintain all animal areas or areas of animal contact; and <br />(b) Has food that is appropriate for the species in adequate amounts to maintain good health, <br />fresh potable drinking water where appropriate, shelter and ventilation, including quarters <br />that are protected from excessive heat and cold and are of sufficient size to permit the <br />animal to exercise and move about freely. <br />Sec. 5 -16 Medical and Grooming Care Requirements. <br />�0 A current "List of Assistance for Beekeeping in Indiana" may be accessed at www.in gov /dnr /entomolo /files /en <br />indiana beekeeping information-pd <br />21 Indiana Code § 3546 -3 -0.1 through Indiana Code § 3546 -3 -15 set forth the State of Indiana's laws addressing <br />"Offenses Relating to Animals ". <br />"Indiana Code § 3546 -3 -0.5 defines neglect of an animal <br />
