REGULAR MEETING AUGUST 25, 2008 <br /> <br /> <br /> <br />SECTION II. The Common Council hereby determines that the property owner is <br />qualified for and is granted Real property tax deduction for a period of five (5) years, and <br />further determines that the petition, the Memorandum of Agreement between the <br />Petitioner and the City of South Bend, and the Statement of Benefits comply with <br />Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code <br />6-1.1-12 et seq. <br /> <br />SECTION III. This Resolution shall be in full force and effect from and after its adoption <br />by the Common Council and approved by the Mayor. <br /> <br /> <br /> s/Timothy A. Rouse <br /> Member of the Common Council <br /> <br /> <br />Councilmember Dieter, Chairperson, Community and Economic Development <br />Committee, reported that this committee held a Public Hearing on this bill this afternoon <br />to hear the pros and cons and voted to send it to the full Council with a favorable <br />recommendation. <br /> <br />Councilmember Puzzello made a motion to hear the substitute version of this bill. <br />Councilmember Dieter seconded the motion which carried by a voice vote of eight (8) <br />ayes. <br /> <br />st <br />Mr. Richard Deahl, Attorney at Law, 600 1 Source Bank Center, 100 North Michigan, <br />South Bend, Indiana, made the presentation for the bill on behalf of the petitioner, Stanz <br />Realty Co., LLP/Stanz Foodservice, Inc. <br /> <br />Mr. Deahl advised that Stanz Foodservice is a full-line, food service distribution <br />business. Stanz uses its warehouse and distribution facility to store dry, refrigerated, and <br />frozen goods to facilitate the transfer and delivery of such goods to customers throughout <br />Northern Indiana and Southern Michigan. The proposed project will enable Stanz to <br />increase the size of its warehouse and distribution facility and enhance operating <br />efficiencies through new cold/freezer warehouse technology, and accommodate growth in <br />its full-line grocery warehouse and distribution business. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this Resolution, Councilmember Dieter made a motion to adopt this <br />substitute Resolution. Councilmember White seconded the motion which carried and the <br />Resolution was adopted by a roll call vote of eight (8) ayes. <br /> <br /> <br />RESOLUTION NO. 3896-08 A RESOLUTION CONFIRMING THE <br /> ADOPTION OF A DECLARATORY <br /> RESOLUTION DESIGNATING CERTAIN <br /> AREAS WITHIN THE CITY OF SOUTH BEND, <br /> INDIANA, COMMONLY KNOWN AS 1840 N. <br /> COMMERCE DRIVE TO BE AN ECONOMIC <br /> REVITALIZATION AREA FOR PURPOSES OF <br /> A FIVE (5) YEAR PERSONAL PROPERTY TAX <br /> ABATEMENT FOR STANZ FOODSERVICE, <br /> INC. <br /> <br /> <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has <br />adopted a Declaratory Resolution designating certain areas within the City as Economic <br />Revitalization Areas for the purpose of tax abatement consideration; and <br /> <br /> 11 <br /> <br />
