The proposed use is compatible with the recommendation of the City of South <br />Bend Comprehensive plan; all of which is requested by the South Bend Municipal Code §21- <br />09.03 <br /> <br /> SECTION IV. Approval is subject to the Petitioner complying with the reasonable <br />conditions established by the Board of Zoning Appeals which are on file in the office of the City <br />Clerk. <br /> <br /> SECTION V. Dieter <br /> Member of the Common Council <br /> <br />Councilmember Dr. Fred Ferlic, Chairperson, Zoning & Annexation Committee, reported that <br />this committee held a Public Hearing on this bill this afternoon and voted to send it to the full <br />Council with a favorable recommendation. <br /> <br />Mr. Mark Lyons, Assistant Zoning Administrator, Building Department, 125 S. Lafayette Blvd., <br />South Bend, Indiana, presented the report from the Area Board of Zoning Appeals. <br /> <br />Mr. Lyons advised that the petitioner is seeking a special exception to allow resource recovery <br />facility/transfer station in a “GI” District, on property located at 1020 Webster Street. He stated <br />that the Area Board of Zoning Appeals held a public hearing on November 6, 2013 and sends it <br />to the Common Council with a favorable recommendation. <br /> <br />Mr. Stephen Studer, 4101 Edison Lakes, Mishawaka, Indiana, made the presentation for this bill. <br /> <br />Mr. Studer advised that they are requesting the approval of a special exception to allow for the <br />operation of a Resource Recovery Facility Transfer Station at 1020 Webster Street. He stated <br />that they would use the existing buildings and the areas to the northeast of the existing buildings <br />and the south part of the site would be used for outside storage. They plan to add fencing along <br />those portions of the perimeter of the property to tie to the existing fencing to secure the <br />property. The transfer of recyclable materials will occur in the existing building located along <br />the east side of the site. There would be no storage of recyclable materials outside exposed to <br />the elements. Also, there would be no processing of any recyclable materials on the property. <br />All materials would be transferred from one truck to another within the east building. He stated <br />they plan to add a weigh station north of the existing main building. The main building will <br />house the offices for the facility.
