/a & ORDINANCE NO 50.7 i-7S AN ORDINANCE APPROVING THE FORM AND TERMS OF A LEASE BETWEEN THE SOUTH BEND CIVIC CENTER BUILDING AUTHORITY AND THE CITY OF SOUTH BEND, INDIANA, AND AUTHORIZING THE EXECUTION THEREOF PERTAINING TO THE SOUTH BEND CIVIC CENTER. WHEREAS, the South Bend Civic Center Building Authority has been created under and in pursuance to the provisions of Public Law 220 of the Indiana General Assembly for the year 1975 and all acts amendatory thereof or supplemental thereto (hereinafter referred to as the "Authority ") for the purpose of financing, acquiring, constructing, equipping and leasing to the City of South Bend, Indiana (hereinafter referred to as the "City "), land and a building or buildings for civic purposes (hereinafter referred to as the "Civic Center "); and WHEREAS, it is desired to construct the Civic Center on land hereinafter described; and WHEREAS, plans and drawings bearing dates between June 1, 1975 and August 4, 1975, and specifications bearing dates between June 1, 1975 and August 4, 1975, together with Addenda Numbered 1, 2, 3, 4 and 5 (all of which is marked "Exhibit A" submitted here - with and made a part hereof) for the construction of the Civic Center, have been prepared by Johnson /Burgee, Architects of New York, N. Y. which plans and specifications have been adopted by the Authority and approved by the Mayor and Common Council of the City, the State Board of Health, the State Fire Marshal and all other agencies designated by law to pass upon plans and specifi- cations for public buildings; and WHEREAS, a form of lease between the City and the Authority, which lease is marked "Exhibit B ", attached hereto and made a part hereof, as well as the total cost of the Civic Center, including costs to be paid by the City and costs to be paid by the Authority have been passed and adopted by resolution of the Common Council of the City and approved by the Mayor of the City; and WHEREAS, a notice of public hearing on the proposed Lease before this Common Council was duly given by the required legal publication of notice and said hearing has been held in accordance with said notice and the governing statute. BE IT NOW, THEREFORE, AND IT IS HEREBY ORDAINED by the Common Council of the City of South Bend, Indiana that: SECTION I. The form and terms of the foregoing Lease between South Bend Civic Center Building Authority and the City of South Bend, Indiana marked "Exhibit B" attached hereto and made a part hereof, and the same is in all things approved and confirmed, and the execution of the original of such Lease by the Mayor and the City Clerk is hereby authorized, approved and confirmed. SECTION II. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor.
