626 <br />II REGULAR MEETING APRIL 10TH, 1950 <br />ORDINANCE N0. 3738 <br />AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING <br />THE ISSUANCE AND SALE OF BONDS OF SAID CITY FOR THE PURPOSE <br />OF PROVIDING FUNDS TO BE APPLIED ON THE COST OF CONSTRUCTION <br />AND IMPROVEMENT OF SEDERS, AND EXPENSES INCURRED IN CONNECTION <br />THEREWITH. <br />The Clerk presented to the Council proof of publication and posting of notice of the public hearing on the <br />ordinance proposed to be passed and authorizing the issuance and sale of bonds of said City for the purpose <br />of providing funds to be applied on the cost of construction and improvement of sewers and expenses incurred <br />in connection therewith. <br />On motion duly made, seconded and unanimously carried, said proofs of publication and posting were approved. <br />The presiding officer then announced that the Council was ready to hear all taxpayers interested in the said <br />ordinance. After hearing all taxpayers desiring to be heard on said ordinance, Councilman Albert Tellson <br />moved that Ordinance No. 3738 be read a third time in full and placed upon its final passage. This motion <br />was seconded by Councilman Stanley Korpal and unanimously carried. <br />The Clerk then read Ordinance No. 3738 in full and Councilman Walter C. Erler moved that the ordinance be <br />adopted as read. This motion was seconded by Councilman Cloyd Beetle and on call of the roll was passed on <br />the following votes <br />Ayes.-. Walter C. Brier, Stanley Korpal, Albert Tellson, <br />Lloyd Beetle, Clem Niezgodski, Walter Glass, <br />Alvin Kemper and Chester Muszynski. <br />Nays: None <br />The presiding officer-declared said ordinance to have been duly passed and adopted. <br />Councilman Clem Niezgodski thereupon introduced Ordinance No. 3741 entitled "An Ordinance of the City of South <br />Bend, Indiana, appropriating the sum of One Million Dollars ($1,000,000.00) to be applied on the cost of con- <br />struction and improvement of sewers, and expenses incurred in connection therewith% and moved that the Clerk <br />be instructed to read said ordinance in full. This motion was seconded by Councilman Albert Tellson and <br />carried. The Clerk then read said ordinance in full. <br />Councilman Walter C. Brier then moved that Ordinance No. 3741 be read a second time by title, and that an <br />opportunity be given for the offering of amendments, which motion was seconded by Councilman Cloyd Beetle <br />and carried. The Clerk then read Ordinance No. 3741 the second time by title and no amendments were offered <br />thereto. <br />Councilman Cloyd Bestle then moved that said ordinance be carried over for further consideration until a <br />meeting of the Council to be held on the 24th day of April, 1950, and that a public hearing be held on the <br />24th day of April, 1950, and that a public hearing be held on said ordinance at that meeting; that the City <br />Clerk be instructed to- publish a notice to taxpayers of such public hearing once each week for two weeks in <br />:the South Bend 'Tribune and-South Bend Mirror, the same being newspapers published in the City of South Bend <br />and representing the two leading political parties, and to post said notice in three public places in said <br />City, the first publication and posting to be at least ten (10) days prior to said date. This motion was <br />seconded by Councilman Clem Niezgodski and on call of the roll was adopted by the following votes <br />Ayes: Walter C. Brier, Stanley Korpal, Albert. Tellson, <br />Cloyd Bestle, Clem Niezgodski, Walter Glass, <br />Alvin Kemper and Chester Muszynski. • <br />Nays: None <br />The presiding officer declared said motion carried and instructed the City Clerk to publish and post notice of <br />said public hearing as provided in the foregoing motion. <br />ORDINANCE NO. 3739 <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 OF THE ORDINANCES <br />OF THE CITY OF SOUTH BEND, INDIANA. .� <br />(Lots 23, 24, 25, 27, 28, 29, 30 and 31 in Leeper's 2nd Addition) <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. <br />ORDINANCE N0, 3740 <br />AN ORDINANCE ANNEXING TO AND MAKING A PART OF THE CITY OF SOUTH <br />'BEND, INDIANA, CERTAIN REAL ESTATE IN SECTION (9), TOFNSHIP (37) <br />NORTH, RANGE (2) EAST, IN ST. JOSEPH COUNTY, INDIANA. <br />The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion <br />for suspension of rules. Councilman Niezgodski seconded the motion. Motion carried by a roll call vote of <br />8 ayes - 0 nays* <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS <br />THE ZONING ORDINANCE. (Lots 315, 316, 317, 321, 322 and 323 <br />in Samuel Cottrell's 1st Addition excepting the West 55 feet <br />of Lot 315 and the West 55 feet of the North 11 feet of Lot <br />316 ) <br />Moved by Councilman Kemper, at the request of the petitioner, Mr `.Hbhry Hukill, that the petition be withdrawn. <br />Councilman Glass seconded the motion. Motion carried. <br />
