626 II REGULAR MEETING APRIL 10TH, 1950 ORDINANCE N0. 3738 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE AND SALE OF BONDS OF SAID CITY FOR THE PURPOSE OF PROVIDING FUNDS TO BE APPLIED ON THE COST OF CONSTRUCTION AND IMPROVEMENT OF SEDERS, AND EXPENSES INCURRED IN CONNECTION THEREWITH. The Clerk presented to the Council proof of publication and posting of notice of the public hearing on the ordinance proposed to be passed and authorizing the issuance and sale of bonds of said City for the purpose of providing funds to be applied on the cost of construction and improvement of sewers and expenses incurred in connection therewith. On motion duly made, seconded and unanimously carried, said proofs of publication and posting were approved. The presiding officer then announced that the Council was ready to hear all taxpayers interested in the said ordinance. After hearing all taxpayers desiring to be heard on said ordinance, Councilman Albert Tellson moved that Ordinance No. 3738 be read a third time in full and placed upon its final passage. This motion was seconded by Councilman Stanley Korpal and unanimously carried. The Clerk then read Ordinance No. 3738 in full and Councilman Walter C. Erler moved that the ordinance be adopted as read. This motion was seconded by Councilman Cloyd Beetle and on call of the roll was passed on the following votes Ayes.-. Walter C. Brier, Stanley Korpal, Albert Tellson, Lloyd Beetle, Clem Niezgodski, Walter Glass, Alvin Kemper and Chester Muszynski. Nays: None The presiding officer-declared said ordinance to have been duly passed and adopted. Councilman Clem Niezgodski thereupon introduced Ordinance No. 3741 entitled "An Ordinance of the City of South Bend, Indiana, appropriating the sum of One Million Dollars ($1,000,000.00) to be applied on the cost of con- struction and improvement of sewers, and expenses incurred in connection therewith% and moved that the Clerk be instructed to read said ordinance in full. This motion was seconded by Councilman Albert Tellson and carried. The Clerk then read said ordinance in full. Councilman Walter C. Brier then moved that Ordinance No. 3741 be read a second time by title, and that an opportunity be given for the offering of amendments, which motion was seconded by Councilman Cloyd Beetle and carried. The Clerk then read Ordinance No. 3741 the second time by title and no amendments were offered thereto. Councilman Cloyd Bestle then moved that said ordinance be carried over for further consideration until a meeting of the Council to be held on the 24th day of April, 1950, and that a public hearing be held on the 24th day of April, 1950, and that a public hearing be held on said ordinance at that meeting; that the City Clerk be instructed to- publish a notice to taxpayers of such public hearing once each week for two weeks in :the South Bend 'Tribune and-South Bend Mirror, the same being newspapers published in the City of South Bend and representing the two leading political parties, and to post said notice in three public places in said City, the first publication and posting to be at least ten (10) days prior to said date. This motion was seconded by Councilman Clem Niezgodski and on call of the roll was adopted by the following votes Ayes: Walter C. Brier, Stanley Korpal, Albert. Tellson, Cloyd Bestle, Clem Niezgodski, Walter Glass, Alvin Kemper and Chester Muszynski. • Nays: None The presiding officer declared said motion carried and instructed the City Clerk to publish and post notice of said public hearing as provided in the foregoing motion. ORDINANCE NO. 3739 AN ORDINANCE AMENDING ORDINANCE NO. 3702 OF THE ORDINANCES OF THE CITY OF SOUTH BEND, INDIANA. .� (Lots 23, 24, 25, 27, 28, 29, 30 and 31 in Leeper's 2nd Addition) The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE N0, 3740 AN ORDINANCE ANNEXING TO AND MAKING A PART OF THE CITY OF SOUTH 'BEND, INDIANA, CERTAIN REAL ESTATE IN SECTION (9), TOFNSHIP (37) NORTH, RANGE (2) EAST, IN ST. JOSEPH COUNTY, INDIANA. The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Niezgodski seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays* ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE. (Lots 315, 316, 317, 321, 322 and 323 in Samuel Cottrell's 1st Addition excepting the West 55 feet of Lot 315 and the West 55 feet of the North 11 feet of Lot 316 ) Moved by Councilman Kemper, at the request of the petitioner, Mr `.Hbhry Hukill, that the petition be withdrawn. Councilman Glass seconded the motion. Motion carried.
