NOVEMBER 22ND, 1948 <br />1. The proper officers of the City Water Works of South Bend, Indiana, be, and the same are, hereby <br />authorized and directed to transfer forthwith, the sum of Twenty - Thousand Dollars ($20,000900) from and out <br />of the funds of said Tater Works to the General Fund of the City of South Bend. <br />2. This Resolution shall be in full force and effect from and after its adoption by the Common Council <br />and its approval by the Mayor. <br />W. C. Councilman Muezynski seconded the motion. <br />Motion carried. <br />ORDINANCE N0. 3679 <br />AN ORDINANCE CONCERNING THE CONSTRUCTION OF EXTENSIONS AND <br />ADDITIONS TO THE WATERWORKS OWNED AND OPERATED BY THE CITY <br />OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE OF REVMWE <br />BONDS TO PROVIDE FOR THE COST THEREOF, AND MATTERS CONNECTED <br />THEREWITH. <br />The Clerk presented and read to the Council the resolution adopted by the Board of Public Works and Safety <br />requesting the Council to authorize the issuance of waterworks revenue bonds to provide funds for certain <br />improvements to the waterworks, said resolution being as follows. to-wit: <br />'RESOLUTION OF THE BOARD OF PUBLIC WORKS AND SAFETY" <br />WHEREAS,..The Board of Public Works and Safety, acting as Waterworks Commissioners, has <br />heretofore determined that certain additions and extensions to the waterworks owned and <br />operated by the City of South Bend are required in order to provide for additional water <br />supply., water storage and to improve distribution, and has employed Charles W. Cole & <br />Son, consulting engineers of South Bend, to assist in determining the exact additions <br />and extensions needed and the estimated cost thereof; and <br />WHEREAS, the additions and extensions recommended by said engineers included the construction <br />and installation of a twenty-four inch South Side Main, two new wells, seven million gallon <br />elevated ground storage tank, Coquillard Supply Main, Sample Street Supply Main, addition to <br />booster station, and Northwest Supply Main, and the estimated cost thereof, including all <br />incidental expenses necessary to be incurred in connection with said project and the issuance <br />of revenue bonds on account thereof is in the amount of Nine Hundred Fifty Thousand Two Hundred <br />Forty -six Dollars ($950,246.00); and <br />WHEREAS, in order to obtain Rinds for application on said project it will be necessary to issue <br />revenue bonds payable out -of the future - revenues of the waterworks, and a form of ordinance for <br />that purpose ^.has.:been .pr.epar.ed. at the request of the Board of Public Works and Safety by Ross <br />McCord.Ice & Miller, bond counsel of Indianapolis, which Form of- ordinance.is satisfactory to <br />the Board of Public Works and Safety; now therefore# <br />BE IT RESOLVED by the Board. of Public Works and Safety of the City of South Bend: <br />1. That the additions and extensions to the municipal waterworks of the City recommended by <br />the consulting engineers be approved, and that, subject to proper action by the Common Council <br />and the Poblic Service 'Commission of Indiana, this Board determine to proceed with the qon- <br />struction and installation of the additions and extensions hereinabove referred to. <br />2. That, subject to proper action by the Common Council and the Public Service Commission of <br />Indiana, the cost of said additions and extensions be financed by the issuance of revenue bonds <br />in the amount of Nine Hundred Fifty Thousand Dollars ($950,000.00), which bonds and the interest <br />thereon shall be payable solely out of future revenues of the municipal waterworks of the City, <br />and that,said bonds be issued in-aocordance with the terms and conditions set out in the form <br />of ordinance prepared by bond counsel employed by the Board of Public Works and Safety, and that <br />said form of ordinance be approved. <br />3. That a copy of this resolution and said form of ordinance be presented to the Common Council <br />for consideration and action as soon as may be done, in view of the fact that the proceeds of <br />said bonds will be needed for application on said project on or about March 1, 1949, and such <br />bonds cannot be issued until approved by the Public Service Commission of Indiana. <br />49 That in the event said ordinance shall be enacted by the Common Council, then a proper <br />petition shall be filed with the Public Service Commission of Indiana requesting authority to <br />proceed with the construction and installation of said additions and extensions and the issuance <br />of said bonds. <br />Dated this 22nd day of November, 19481 <br />(Signed) <br />" <br />Board of Public Works and Safety <br />Councilman Meg <br />godski thereupon introduced Ordinance No. 3679 entitled "An Ordinance concerning the construction <br />of extensions and additions to the Water Works owned and operated by the City of South Bend, Indiana, authorizing <br />the issuance of revenue bonds to provide for the cost thereof, and matters connected therewith" and moved that <br />the Clerk be instructed to read said Ordinance in full. <br />This motion was seconded by Councilman Tellson and carried. The Clerk then read said ordinance in full. <br />Councilman Tellson then moved that said ordinance be read a second time by title, and that an opportunity be <br />given for the offering of amendments, which motion was seconded by Councilman Korpal and carried. The Clerk <br />then read the said Ordinance No. 3679 the second time by title. No amendments were offered thereto. <br />
