REGULAR METING SEPTEMBER 27, 1965 <br />REPORT OF CITY PLANNING COMMISION <br />September 8, 1965 <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />The attached petition of Myron D. Walz, at al, to rezone from "B" Residential Use and <br />"A" Height and Area District to "C" Commercial Use and "E" Height and Area District <br />Lot 11, 10 and all of 12 except the North 10 feet thereof to John E. Walz revised addition <br />to the City of South Bend, begng generally described as the west side of the 3400 <br />brlock S. Michigan Street was legally advertised under date of August 23, 1965 and <br />given public hearing on September 2, 1965. The following action was taken: <br />After due consideration the Commission found that the proposed <br />zoning would be in the best interest of the subject property <br />and would have no adverse effect on the surrounding property. <br />It was therefore duly moved, seconded and unanimously carried that the <br />petition be recommended favorably to the Council. <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />/s/ Robert L. Motion carried. <br />REPORT OF CITY PLANNING COMMISSION <br />September 10, 1965 <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />The attached petition of Robert and Betsey Corthier returned by the Council <br />on June 14, 1965, for further study by the Commission, was considered under <br />date of September 2, 1965 and the following action taken: <br />After due consideration the Commission found that while <br />much vacant land exists in the general vicinity, no evidence <br />exists that the current zoning of the subject property <br />denies the property owners of a reasonable use or return <br />from their land; that the petitioners request a rezoning of <br />of an arbitrarily shaped piede of land; that its boundaries <br />violate all the accepted standards concerning zoning <br />district boundaries; that by its location it constitutes <br />a spot zone and that a rezoning of this property, based <br />upon the presently known facts would-be arbitrary and <br />capricious in nature and would not follow the Future <br />Land Use Plan, It was therefore duly moved,seconded and <br />unanimously carried that the petition be recommended <br />unfavorably to the Council for the second time. <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />/s/ Robert L. Motion carried. <br />REPORT OF CITY PLANNING COMMISSION <br />September 10, 1965 <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />The attached petition of the City Planning Commission to zone "A" Residential Use and "A" Height <br />and Area District the recently annexed land generally described as a rectangular parcel <br />approximately 358 feet by 837.5 feet on the East aide of York.Road commencing hpproximately <br />370 feet south Jackson Road was legally advertised under date of August 23, 1965 'and given <br />public hearing on September 2, 1965. The following action was taken: <br />After due consideration the Commission found that the proposed <br />zoning would be in the best interest of the subject property <br />and the surrounding area.
