<br />IIRESOLUTION NO. 106 -65 (Amended by Resolution 126 -66)
<br />RESOLUTION OF THE ,COMMON COUNCIL OF THE CITY OF SOUTH BEND,
<br />INDIANA, APPROVING THE UNDERTAKING OF SURVEYS AND PLANS FOR
<br />AN URBAN RENEWAL PROJECT AND THE FILING OF AN APPLICATION.
<br />Whereas, under Title I of the Housing Act of 1949, as amended (Herein referred to as "Title I"),
<br />the Housing and Home Finance Administrator is authorized to extend financial assistance to local
<br />public agencies in the elimination and prevention of the spread of their slums and urban blight
<br />through the planning and undertaking of urban renewal projects; and
<br />Whereas, it is desirable and in the public interest that the City of South Bend, Department of
<br />Redevelopment make surveys and prepare plans, presently estimated to cost approximately One Hundred
<br />Eighty One Thousand, Two Hundred and Ninety Two Dollars ($181,292), in order to undertake and carry
<br />out an urban renewal project of the character contemplated by Section 110(c) of Title I in the propos-
<br />ed Urban Renewal Area, situated in the City of South Bend, County of St. Joseph and State of Indiana,
<br />which is described as follows:
<br />Beginning at a point which is the intersection of the north line of LaSalle Street
<br />and the west line of Main Street; thence easterly along the north line of LaSalle Street
<br />to the west bank of the St. Joseph River; thence southeasterly along the west bank of
<br />the St. Joseph River to the south line of Jefferson Boulevard; thence westerly along the
<br />south line of Jefferson Boulevard to the east line of St. Joseph Street; thence southerly
<br />along the east line of St. Joseph Street to the south line.of Monroe Street extended; thence
<br />westerly along the south line of Monroe Street to the west line of Main Street extended; thence
<br />northerly along the west line of Main Street to the south line of Western Avenue; thence
<br />westerly along the south line of Western Avenue to the west alley line of the first alley west of
<br />Lafayette Boulevard; thence northerly along said alley extended to the north line of
<br />Washington Street; thence easterly along the north line of Washington Street to the west
<br />line of Main Street; and thence northerly along the west line of Main Street to the point
<br />of beginning.
<br />NOW, THEREFORE, BE IT RESOLVED BY TIE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA:
<br />1. That the proposed urban Renewal Area described above is a slum, blighted, deteriorated, or
<br />deteriorate" area appropriate for an urban renewal project n8 ect and that the undertaking b the City f

<br />South Bend, Department of Redevelopment surveys and plans for an urban renewal project of the
<br />character contemplated by Section 110(c) of Title I in the proposed Urban Renewal Area is hereby approved.
<br />2. That the financial assistance available under Title I is needed to enable the City of South Bend,
<br />Department of Redevelopment to finance the planning and undertaking of the proposed Project.
<br />3. That it is cognizant of the conditions that are imposed in the undertaking and carrying out
<br />of urban renewal projects with Federal financial assistance under Title I, including those relating to
<br />(a) the relocation of site occupants, (b) the provision of local g rants -in -aid
<br />(c) the prohibition of
<br />discrimination because of race, color, creed, or national origin, and (d) the requirement that the locality
<br />present to the Housing and Home Finanae Administrator, as a prerequisite to approval of the application
<br />described below, a workable program for community improvement, as set forth in Section 101(e) of Title I,
<br />for utilizing appropriate public and private resources to eleiminate and prevent the development or
<br />spread of slums =and urban blight.
<br />EXCERPTS OF SECTION 110 (c) OF TITLE I
<br />Section 110(c) of Title I. which is the Urban Renewal portion of<the Housing Acto of 1949 as amended,
<br />covers definition of urban renewal projects. This section describes an urban renewal project and the
<br />general objectives of elimination and prevention of the development and spread of slums and blight
<br />and covers the activities of clearance and rehabilitation. This section also discusses residential and
<br />non - residential development.
<br />Section 110(c) was amended by the "Housing and Urban Development Act of 1965" (Public Law 89 -117), which
<br />was approved by the President on August 10, 1965. The change now permits 35% of the additional capital
<br />grants authorized by the 1965 Act to be used for "non - residential exception" projects (commercial and
<br />industrial projects). In 1949 only 10% of capital grants were available for commercial and industrial
<br />projects. The newest change also stipulates that not less than 10% of Federal grants authorized by the
<br />1965 Act and direct rehabilitation loans be made available for projects which involve primarily Code
<br />enforcement and rehabilitation.
