REPORT OF CITY PLANNING COMMISSION January 8, 1962 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: Under date of January 4, 1962, the Commission took the following action in regards to your communication relative to amending the petition of Genevieve and Frederic C. Wimkler and Alfreda W. Walter to rezone the property most generall inown as 937 South Bend Avenue from "B" Residential Use and "B" Height and Area District to "C" Commercial Use and "D" Height and Area District, by excluding the west fifty feet of said property from the petition area: After due consideration the Commission unanimously voted to approve said amendment. Thereby, under the provisions of Chapter 174, Acts of 1947, the ordinance stands as passed by the Council, as of the date of the recording of the Commission's report to the Council. Councilman Tellson seconded the motion. Motion carried. Councilman Lehman made a motion that the Ordinance be set for public hearing on January 22, 1962. Councilman Allen seconded the motion. Motion carried. ORDINANCE FIRST AND SECOND READING AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (49.5 acres from present City Limits to Ireland Road, east and west of Michigan Street) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on January 22, 19.62. Councilman Lehman seconded the motion. Motion carried. ORDINANCE NO. .4426 --- 62 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (65 acres between Ironwood and Miami from the present City Limits South to Jackson Road) The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion for sus- pension of the rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays (Councilman Krueper being absent from the Council Chambers at the time the vote was taken). The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays. (Councilman Krueper being absent from the Council Chambers when the vote was taken). ORDINANCE NO. 4427 - - -62 AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS- TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE .GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945 AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1951 The Ordinance was given first reading by title and second reading in full. Councilman ;:,Lehman made a motion for suspension of the rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4428 - - -62 AN ORDINANCE TO ESTABLISH A MERIT SYSTEM OF PERSONNEL. ADMINISTRATION FOR EMPLOYEES OF THE CIVIL DEFENSE AGENCY OF THE CITY OF SOUTH BEND The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of the rules. Councilman Coleman seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4429 - - -62 AN ORDINANCE ORDERING AND PROVIDING FOR THE SALE OF CERTAIN REAL ESTATE IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, WHICH SAID REAL ESTATE IS OWNED BY SAID CITY FOR USE OF ITS PARK DEPARTMENT. (J. D. Oliver Park) The Ordinance was given first reading by title and second reading in full.
