ORDINANCE NO. 4408 - - -61 <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE OFFICE OF THE CONTROLLER, $850.00 <br />The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. <br />REPORT OF CITY PLANNING COMMISSION <br />October 18, 1961 <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />The attached petition of the City Planning Commission to rezone Lots Numbered 2, 4, and 6, Hickey's Sub., Lots <br />Numbered 19, 20, 21 and 22, University Place, and also beginning at the northwest corner of Howard Street and <br />Lawrence Street, thence west 159.37 feet, more or less, thence north 198.feet, thence east 159.37 feet, thence south <br />to the place of beginning containing three lots, and also beginning at the south west corner of Howard Street, thenc <br />West 159.37 feet ;. more or less, thence South 198 feet, thence east 159.37 feet, thence north 198 feet, containing <br />three lots, being generally described as being the four corners formed by the intersection of Howard and Lawrence <br />Streets, from "C" Commercial Use and "D" Height and Area District to "B" Residential Use and "B" Height and Area <br />District was legally advertised under date of May 22, 1961 and given public hearing on June 1, 1961. The following <br />action was taken: <br />After due consideration the Commission found that all of the lots in question except the northwest corner of Howard <br />and Lawrence Streets have over the years been used for residences and not commercially, that the immediate area is <br />comprised of sound residential dwellings, and that any further expansion of commercial uses is unwarranted and could <br />adversely affect the residential character of the area. it.was therefore duly moved, seconded, and unanimously <br />carried that the petition be recommended favorably to the Common Council. <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />/s/ Robert L. Motion carried. <br />ORDINANCE, FIRST AND SECOND_'READING <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF <br />THE CITY OF SOUTH BEND, INDIANA' <br />(Four Corners of Howard and Lawrence Streets) <br />The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that <br />the Ordinance be set for public hearing on November 27, 1961. Councilman Krueper seconded the motion. Motion <br />carried. <br />Councilman Lehman moved that the original Television Ordinance, which was referred to the Ordinance Committee, be <br />withdrawn so that a new Ordinance could be introduced. Councilman Muszynski seconded the motion. Motion carried <br />by a roll call vote of 9 ayes, 0 nays. <br />ORDINANCE, FIRST AND SECOND READING <br />AN ORDINANCE TO REGULATE THE BUSINESS OF INSTALLING AND SERVICING TELEVISON <br />EQUIPMENT IN THE CITY OF SOUTH BEND; TO PROVIDE FOR THE ADMINISTRATION AND <br />ENFORCEMENT OF THIS ORDINANCE; AND TO PROVIDE A PENALTY FOR THE VIOLATION OF <br />THE TERMS THEREOF. <br />The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the <br />Ordinance be set for public hearing on November 27,. 1961. Councilman Allen seconded the motion. Motion carried. <br />OLD BUSINESS <br />Councilman Tellson requested the City Attorney to investigate regulations concerning fallout shelters. The City <br />Attorney 'informed Mr. Tellson that the new Building Code would adequately covern construction of a fallout shelter, <br />but would suggest that Mr. Tellson and Mr. Krueper meet with the Building Commissioner, Verner Lane, for discussion. <br />NEW BUSINESS <br />Councilman Allen stated that he wished to call to the attention of the Council the new procedure of our very com- <br />petent City Clerk, a written resume of the previous Council Meeting, and he made a motion that the Council thank <br />the City Clerk for the procedure and trust that she will keep it up. Councilman Lehman seconded the motion. Motion <br />carried. <br />Councilman Ladewski presented the following petition which was read by the Clerk: <br />October 23, 1961 <br />PETITION <br />WHEREAS, There has been a very apparent increase in vehicular traffic in the 1600 block of Western Avenue due to <br />increased construction of residential and commercial buildings, and, <br />WHEREAS:, this very marked increase in traffic creates a hazardous condition for both pedestrian and motorist alike, <br />and, <br />
