REPORT OF CITY PLANNING COMMISSION To the Common Council of City of South Bend South Bend, Indiana Gentlemen: the City of South Bend October 7, 1959 The attached petition of Edward Meredith, et al, to rezone Lots 7 -13, inclusive, of Morris Park Addition, located at 1601 and 1625 Portage Avenue, from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and 11D" Height and Area District was legally advertised on August 24, 1959 and given public hearing under date of September 3, 1959. The following action was taken: RLH /mah Attach. After due consideration the Commission found that ample commercially zoned area existed in the immediate vicinity and that a large amount of this land was not used commercially and that further a large amount of this land was vacant. The Commission therefore found that no need existed for proposed zoning and that said zoning would result in 1) an unwarranted intrusion into a predominantly residential area of commercial use, 2) an unwarranted and undesirable extention of strip zoning. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: October 7, 1959 The attached petition of Austin F. Riggs, et al, to rezone Lots Numbered 113, 114, and 115 in Sorins Second Addition to the City of South Bend, Indiana located at 920 North Frances Street from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "D" Height and Area District was legally advertised on September 21, 1959 and given public hearing under date of October 1, 1959. The following action was taken: After due consideration the Commission found that commercial zoning of subject property would result in a logical expansion of commercial zoning. It was therefore duly moved, seconded and unanimously carried that the petition be recommended favorably to the Council. Also attached is a consent petition bearing fourty -one signatures, being approximately 98 per cent of the property owners in the immediate vicinity. RLH /mah 2 attachs. Meredithg- -Lots 7 to 13, Morris Park Addn.) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on November 9, 1959. Councilman Erler seconded the motion. Motion carried. ORDINANCE NO. 4284 AN ORDINANCE AMENDING ORDINANCE NO. 3702, AS AMENDED, COMMONLY KNOWN AS „THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND; INDIANA" (Austin. Riggs, et al, Land located at N. Francis & Howard Streets) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Hahn. The Ordinance was then given third reading and passed by a roll call vore of 8 ayes, 0 nays. 1 absent (Councilman Hahn.)
