REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend : Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Land at Eddy and East Jefferson), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED UNFAVORABLE. /s/ Joseph T. Kroll, Chairman May 25, 1959 Councilman Erhardt made a motion that the report be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. ORDINANCE NO. 4264 - - -59 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SOUTH BEND, INDIANA (Clay Township) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4265 - - -59 AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (West Ewing Ave.) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0. 3702 (Eddy and Jefferson) The Ordinance was given third reading and lost by a roll call vote of 7 nays, 2 ayes, (Councilmen Muszynski and Christman) ORDINANCE NO. 4266 - - -59 AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY CONTIGUOUS THERETO (Broadmoor) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. RESOLUTION RESOLUTION OF TIE COMMON COUNCIL OF THE CITY OF SOUTH BEND CREATING A BUILDING AUTHORITY WHEREAS, the creation o£.a'Building_- .Authority to be a body corporate and politic is authorized by the statutes of Indiana for the purpose of financing, acquiring, constructing, equipping, operating and leasing to the governmental units within the territorial boundaries of the county, lands or buildings for public or governmental purposes; and WHEREAS, it is deemed in the public interest for the creation of such an authority in'St. Joseph County to be con- sidered in public hearing to be held and conducted by the Board of Commissioners of the County of St. Joseph, the St. Joseph County Council and the Common Council of the City of South Bend, Indiana, NOW, THEREFORE, be it resolved by the Common Council of the City of South Bend that there be filed with the Auditox of St. Joseph County as provided by law a notice to be signed by the President of this Council stating that this body has agreed, and this body does-hereby so-agree, to held a public hearing on and consider the creation of such an authority to be known as "South Bend - St. Joseph County Building Authority " on June 9, 1959, at 7:30 o`Clock P.M., in the St. Joseph Circuit Court Room in South Bend, Indiana, which said notice shall be signed also by the presiding officers of the Board of Commissioners of the County of St. Joseph and the St. Joseph County Council, stating the agreement of those bodies if said bodies so agree and the Auditor of St. Joseph County shall give notice as provided by law. Done this 25th day of May, 1959. /s/ Stanley C. Korpal President of the Common Council. Councilman Kroll made a motion for adoption of the Resolution. Councilman Muszynski seconded the motion. Motion unanimously carried. Resolution adopted. RESOLUTION A RESOLUTION APPROVING A FORM OF CONTRACT AMENDING THE COOPERATION AGREEMENT OF SEPTEMBER 11, 1956 BETWEEN THE CITY OF SOUTH BEND, INDIANA, AND THE HOUSING AUTHORITY OF THE CITY OF SOUTH BEND, INDIANA The Clerk read the Resolution in its entirety. Councilman Erler made a motion that the Resolution be set for public hearing on June 8, 1959. seconded the motion. Motion carried. Councilman Glass
