REPORT OF CITY PLANNING COMMISSION: <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />July 14, 1958 <br />The attached petition of Edward Heston to rezone Lots 45 and 46 of Krow and Whitmore's Subdivision, located at <br />2904 South Michigan Street, from "A" Residential Use District and "A" Height and Area District to 1°C" Commercial <br />Use District and "D ".Height and Area District was legally advertised on 30 June 1958 and given public hearing under <br />date of 10 July 1958. The following actim was taken: <br />After due consideration the Commission found that substantial justice would be done by the favorable <br />recommendation of the petition. Motion carried. <br />ORDINANCES, FIRST AND SECOND READING: <br />ORDINANCE: <br />AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS <br />THE ZONING ORDINANCE OF THE CITY OF SOUTH BENIN INDIANA (Lots 46 & 46 Krou & Whitmore;s Sub) <br />(2900 Block S. Michigan Street) <br />The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for <br />suspension of rules. Councilman'Kroll seconded the motion. Motion lost by a' roll call vote of 7 ayes (Councilmen <br />Korpal, Carr, Tellson, Kroll, Glass, Hahn and Muszynski), 2 nays (Councilmen Christman and Erler). <br />Councilman Hahn made a motion that the Ordinance be set for public hearing on July 28, 1958. Councilman Carr <br />seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE ORDERING AND PROVIDING FOR THE SALE OF CERTAIN REAL ESTATE IN THE CITY OF SOUTH <br />BEND, ST. JOSEPH COUNTY, INDIANA, WHICH SAID REAL ESTATE IS OWNED BY SAID CITY FOR USE OF <br />ITS PARK DEPARTMENT <br />The Ordinance was given first reading by title and second reading in full. Councilman Christman made a motion that <br />the Ordinance be set for public hearing on July 28, 1958. Councilman Kroll seconded the motion. Motion carried. <br />ORDINANCE NO. 4233 <br />AN ORDINANCE APPROVING A LEASE BETWEEN THE MUNICIPAL CITY OF SOUTH BEND AND THE FRATERNAL ORDER <br />OF POLICE OF SOUTH BEND FOR THE LEASING OF THE FOLLOWING DESCRIBED REAL ESTATE: Beginning on the <br />east and west centerline of Section 27, Township 38 North, Range 2 East, a distance of 1430.6 <br />feet east of the west quarter corner of said Section 27; thence North 445 feet; thence East <br />parallel to and with the said east and west centerline of said section a distance of 723.3 feet; <br />thence South 445 feet to said centerline of Section 27; thence West 723.3 feet to the place of <br />beginning. This tract is located in the Northwest quarter Section 27, Township 38 North, Range <br />2 East, German Township, St. Joseph County, Indiana, and contains 7.36 acres, more or less. <br />The Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion for <br />suspension of rules. Councilman Carr seconded the motion. Motion carried by a roll call vote of 9 ayes, O nays. <br />The Ordinance was then given third reading and passed by a roll call vote of .9 ayes, 0 nays. <br />ORDINANCE <br />AN ORDINANCE TRANSFERRING FROM FIRE DEPARTMENT ACCOUNT Q -11 - _PERSONAL SERVICES THE SUM OF <br />$9,045.15 TO FIRE DEPARTMENT ACCOUNT Q -214 - TELEPHONE '$140.00, and TO FIRE DEPAR- MIAENT <br />ACCOUNT @ -321 - COAL $2,405.15, AND TO FIRE DEPARTMENT ACCOUNT Q -231 GASOLINE $500.00, <br />AND TO FIRE DEPARTMENT ACCOUNT Q -712 - OTHER STRUCTURES $6,000.00; AND TRANSFERRING FROM <br />ELECTRICAL DEPARTMENT ACCOUNT V -38 - GENERAL SUPPLIES $2,500.00 TO ELECTRICAL DEPARTMENT <br />ACCOUNT V -261 - OTHER CONTRACTUAL SERVICES, ALL OF THE BUDGET FOR THE YEAR 1958 DF THE <br />CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. <br />The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion that the <br />Ordinance be set for Public Hearing on July 28, 1958. Councilman Kroll seconded the motion. Motion carried. <br />RESOLUTION <br />WHEREAS, under Title I of the Housing Act of 1949, as amended, and the Housing Act of 1954 as amended, <br />the Housing and Home Finance Administrator is authorized to extend financial assistance to localities in the <br />elimination and prevention of the spread of their slums and urban blight through the planning and undertaking of <br />urban renewal projects; and <br />WHEREAS, it is desirable and in the public interest that the South Bend Redevelopment Commission prepare <br />surveys and plans, presently estimated to cost approximately $137,000 (one - hundred thirty -seven thousand dollars) , <br />in order to undertake and carry out an urban renewal project of the character contemplated by Section 110(c) of <br />said Title I, in that certain area, proposed as an Urban Renewal Area, situated in the City of South Bend, County of <br />St. Joseph, and State of Indiana, and described as follows: <br />Beginning at the intersection of the westerly right of way line of`Chapin Street with the <br />southerly right of way line of the New York Central Main Line right of way; thence, in ar <br />easterly direction along the southerly right of way line of said New York Central right of <br />way for a distance of approximately 720.feet to the intersection with the easterly right c <br />way line of Scott Street; thence in a southerly direction along.said easterly right of wE <br />
