REGULAR MEETING NOVEMBER 24, 1969 <br />PETITIONS <br />Petition to Amend Zoning Ordinance Location: Fillmore Road and Lombardy <br />I, the undersigned, do hereby respectfully make application and petition the Common <br />Council of the City of South Bend to amend the Zoning Ordinance of the City of South Bend, Indi- <br />ana as hereinafter requested, and in support of this application, the following facts are shown: <br />1. The property sought to be rezoned is located at Fillmore and Lombardy. <br />2. The property is owned by Neva Templeton. <br />3. A legal description of the property is as follows: <br />Part of the Southeast Quarter of the Southeast Quarter of Section Five (5), Township thirty -seven <br />(37) North, Range Two (2) East, described as following, beginning at the Southeast corner of said <br />Section Five (5), running thence North along the East line of said Section, Nine Hundred Eighty <br />Six and Two Tenths (586.2) feet; thence West Nine Hundred Ninety and Three Tenths (990.3) feet; <br />thence South Nine Hundred Eighty Eight (988) feet to the South line of said Section Five (5); <br />thence East along said South line of said Section Five (5), One Hundred Fifty One (151) feet; <br />thence North Four Hundred Seventy Six (476) feet; thence East Two Hundred Sixty (260) feet, <br />thence South Four Hundred Seventy Six (476) feet, thence East Five Hundred Eighty Two and One <br />Tenth (582.1 feet to the place of beginning, containing Nineteen and Sixty -three Hundredths <br />(19.63) acres, more or less, in St. Joseph County, Indiana And <br />Part of the Southeast Quarter (1/4 of the Southeast Quarter (1/4) of Section Five (5), Township <br />Thirty -seven (37) North, Range Two (2) East, described as beginning at the Southwest corner <br />thereof, running thence North Nine Hundred Eighty -eight (988) feet; thence East Three Hundred <br />Thirty (330) feet; thence South and parallel to the West line of the Southeast Quarter (1 /4) of <br />said Section Five (5), Nine Hundred Eighty -eight (988) feet to the South line of said Section <br />Five (5); thence West:on`the_,.South'section line Three Hundred Thirty (330) feet to the place of <br />beginning, containing Seven and Forty -eight Hundredths (7.48) acres, more or less, in St. Joseph <br />County, Indiana. Subject to legal highways. <br />Also commonly known and described as and located at Northwest corner of the intersection of <br />Filmore Road (sometimes known as Linden Avenue) and Lombardy Drive extended North. <br />The realestate above described is unzoned newly annexed real estate and <br />4. It is desired and requested that the foregoing property be zoned: <br />To A residence Use and A height and area District. <br />5. It is proposed that the property will be put to the following use and the following buildings <br />will be constructed: This area. will be sub - divided for single family dwellings. This real <br />estate will be sub - divided into 118 residence lots for single family residence purposes only and <br />118 single family dwelling houses will be constructed. <br />6. Number of off street parking spaces to be provided: Each lot will be adequate in area <br />within the requirements of the sub - division ordinance to provide adequate area for off - street <br />parking by residents of the single family dwelling units to.be constructed. <br />7. Attached is a copy of (a) an existing plot plan showing the property and other surrounding <br />properties; (b) names and addresses of all the individuals, firms or corporations owning <br />property within 300 feet of the property sought to be rezoned; (c) site development plan. <br />Ls/ Neva L. This petition is, as stated, for the zoning of a tract of land newly annexed to the <br />City of South Bend. It is to be used for single family dwellings only and not otherwise. The <br />attached proposed form of plat represents the general sub - division plan but is being revised in <br />accordance with suggestions of the Area Plan Commission and is therefore not to be understood <br />to be the final form which the sub - division plan will take. <br />This petition, being a petition to zone A Residence District and A Height and Area <br />District does not involve an overall site development plan and therefore no such information is <br />required by Section 23 -A of the Zoning Ordinance of the City of South Bend nor can it be nor is <br />it attached hereto. The proposed sib- division plan is attached for information purposes. <br />F.
