ORDINANCE <br />COMMITTEE OF THE WHOLE MEETING <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 4990 <br />CHAPTER 40 OF THE MUNICIPAL CODE(FORMERLY ZONING ORDINANCE <br />NO,3702). (Location: Land located near the Northwest corner <br />of the intersection of McKinley Avenue and Hickory Road in <br />the City of South Bend, Indiana) <br />NOVEMBER 10, 1969 <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Speaking for the L. S. Ayres Company, <br />the petitioner, was Mr. Richard 0. Ristine, Vice- President and Treasurer of L. S. Ayres Company. <br />He said both an Ayr -way discount store and a regular Ayres department and a theatre are eventually <br />to be built. He stated that this type of store will be the first of its kind in industry. Mr. <br />Boughner, 534 Preston Drive, South Bend, said he favored this type of business being built in the <br />area. Councilman Allen made a motion that the Ordinance go to the Council as favorable. Council - <br />man Palmer seconded the motion. Motion carried. <br />(ORDINANCE <br />AN ORDINANCE APPROPRIATING LOCAL ROAD AND STREET ACCOUNT <br />FUNDS FOR THE FISCAL YEAR ENDING DECEMBER 31, 1969. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. City Controller James A. Bickel <br />explained the purpose of the Ordinance. He stated that Chapter 392 of the Acts of 1969 makes <br />available to all cities, additional funds for engineering construction or reconstruction of <br />roads, streets and bridges. The additional funds are those funds resulting from the 7th and 8th <br />cents of the gasoline tax. The State Auditor deposits °these funds monthly in a special account <br />called the "Local Road and Street Account. The funds are held in escrow until such time as <br />the City submits an application for an approved project and receives the approval of the State <br />Arterial Road and Street Board and the State Auditor. After these approvals, the State Auditor <br />issues a check to the City for the approved amount. The City of South Bend has submitted 14 <br />(project applications.. All 14 projects have received the approval of the State Road and Street <br />Board and the Auditor of State and the funds have been received and deposited. This ordinance <br />is to comply ith the requirements to appropriate all funds involved in the 14 projects. Councilman <br />Laven made the motion and Councilman Zielaiski seconded the motion that the Ordinance go to the Counc <br />ORDINANCE as favorable. Motion carried. <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE <br />MOTOR VEHICLE HIGHWAY FUND IN THE AMOUNT OF $62,727.19 <br />TO VARIOUS ACCOUNTS WITHIN THE MOTOR VEHICLE HIGHWAY <br />FUND. <br />This being the time heretofore: set for.public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. City Controller James A. Bickel ex- <br />plained this ordinance and its relationship to the above Local Road & Street Acct Fund Ordinance. <br />The purpose of this Ordinance is to appropriate the Local Rd. & St. Acct. Fund money to be depos- <br />ited into the Motor Vehicle Highway fund. These additional funds are needed since funds have <br />been expended from regularly appropriated MVH accts. for the completion of R & S 1 and 2, thereby <br />depleting these accounts. City Engineer Lloyd Taylor explained the State legislation pertaining <br />to this transaction. Council n_Maven commended Mr. Taylor for his leadership initiating this <br />type of legislation CouncilnaniZ Wl. ade a motion that the Ordinance go to the Council as <br />favorable. Councilman Zielinski seconded the motion.
