REGULAR MEETING MARCH 24, 1980 <br />REGULAR MEETING RECONVENED (CONTINUED <br />RESOLUTION NO. 769 -80 A RESOLUTION REQUESTING THAT THE AIR POLLUTION OPERATION <br />(resolution follows) PERMIT REQUESTED BY PRENCO, INCORPORATED, BE DENIED. <br />A public hearing was held on the resolution at this time. Council Member Kopczynski indicated <br />a recent survey shows there is no present need for such a soluble oil facility in the area. <br />He inidcated there is a potential danger to the health and safety of our residents by the <br />transporting of such wastes to and from the proposed facility. He indicated that the original <br />plant was proposed to remove any possible oil and certain bacteria growth in our sewers, there- <br />fore necessitating a location near the wastewater treatment plant. Mr. Thomas Waltz, attorney <br />representing the citizens on the southside of South Bend, spoke about the possible danger of <br />this plant being relocated to the southside of the City. Mrs. Jane Swan, 2022 Swygart, spoke <br />against the Prenco operation. Mr. Richard Hill, City Attorney, indicated that the Mayor was <br />opposed to this operation in any residential area. Mr. Bruce Collier, 3532 Langley, spoke <br />against the Prenco operation. Mr. George Divjak, 2015 S. William, spoke against the Prenco <br />operation. Council Member Serge made a motion to adopt this resolution, seconded by Council <br />Member Szymkowiak. The resolution was adopted by a roll call vote of nine ayes. <br />WHEREAS, the Common Council of the City of South Bend, is the elected body which represents <br />the viewpoints of its citizens within the Community; and <br />WHEREAS, the Council recognizes the need to protect the health, safety, and welfare of the <br />Community; and <br />WHEREAS, the City of South Bend, Indiana, and Prenco, Incorporated, a Delaware Corporation <br />entered into an agreement for the maintenance and operation of a Soluble Oil Disposal Facility <br />on December 4, 1978, and the City subsequently terminated said agreement effective September 30, <br />1980; and <br />WHEREAS, the public outcry by the residents against the proposed new location on the <br />Southwest side of South Bendis as great an outcry as those opposing the Riverside location; <br />WHEREAS, a recent survey indicates that there is no present need for such a soluble oil <br />facility in the area; and <br />WHEREAS, there is a potential danger to the health and safety of our residents by the <br />transporting of such wastes to and from the proposed facility. <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, Indiana, <br />as follows: <br />SECTION I. The Common Council requests that the Air Pollution Operation Permit requested <br />by Prenco Incorporated to operate at the southwest side of the City be denied. <br />SECTION II. The Council believes that the potential health and safety dangers and the <br />lack of a present need of such a soluble oil disposal facility in the area are justifible <br />public concerns to deny such a permit. <br />SECTION III. This resolution shall be in full force and effect from and after its adoption <br />by the Common Council and approval by the Mayor. <br />/s /Walter T. Kopczynski <br />Member of the Common Council <br />Council Member Taylor made a mtoion to reconsider Resolution No. 767 -80, for the purpose of <br />correcting an error, seconded by Council Member Dombrowski. The motion carried. Council <br />Member Taylor made a motion to correct the error in Section I to reflect the amount as <br />$52,500.00, seconded by Council Member Dombrowski. The motion carried. <br />BILLS, FIRST READING <br />BILL NO. 26 -80 <br />A BILL FOR APPROPRIATING INTEREST EARNED FROM THE PURCHASE OF <br />CERTIFICATES OF DEPOSIT OUT OF THE PROCEEDS OF THE 1977 PARK <br />DISTRICT BOND CONSTRUCTION FUND 50 IN THE AMOUNT OF $2,636.25. <br />This bill had first reading. Council Member Beck made a motion to set this bill for public <br />hearing and second reading April 14, 1980, seconded by Council Member Dombrowski. The motion <br />carried. <br />BILL NO. 27 -80 A BILL APPROPRIATING THE SUM OF $66,775.15 FROM THE CUMULATIVE <br />SEWER BUILDING AND SINKING FUND TO THE GENERAL IMPROVEMENT FUND. <br />This bill had first reading. Council Member Crone made a motion to set this bill for public <br />hearing and second reading April 14, 1980, seconded by Council Member Voorde. The motion <br />carried. <br />BILL NO. 28 -80 <br />A BILL APPROPRIATING $6,500.00 FROM THE COMMUNITY DEVELOPMENT <br />BLOCK GRANT FUND FOR THE TECHNICAL ASSISTANCE FOR COMMUNITY <br />DEVELOPMENT FISCAL DECISION- MAKING.TO BE ADMINISTERED BY THE <br />CITY OF SOUTH BEND THROUGH ITS DIVISION OF COMMUNITY DEVELOP- <br />MENT. <br />This bill had first reading. Council Member Taylor made a motion to set this bill for public <br />hearing and second reading April 14, 1980, seconded by Council Member Dombrowski. The motion <br />carried. <br />BILL NO. 29 -80 A BILL AMENDING CHAPTER 9, OF THE MUNICIPAL CODE OF THE CITY <br />OF SOUTH BEND, INDIANA, BY THE INCLUSION OF NEW ARTICLE 2 <br />ENTITLED SMOKE DETECTORS. <br />This bill had first reading. Council Member Crone made a motion toset this bill for public <br />hearing and second reading April 14, 1980, seconded by Council Member Dombrowski. The motion <br />carried. <br />
