<br />WHEREAS, for the purpose of paying thr cost of constructing the Parking Facilities the
<br />City has heretofore issued its Off- street Parking Revenue Bonds, Series 1969 Project ( "1969
<br />which bonds are now outstanding in the principal amount of $3,250,000; and
<br />BondsJr') ,
<br />WHEREAS, officers of the City have determined that it would be advantageous to the City to
<br />refinance the 1969 Bonds pursuant to the provisions of Indiana Code 18- 5- 3.3 -8.5, by the con-
<br />veyance of the Parking Facilities to Parking Facilities of South Bend, Inc. ( "Corporation "),
<br />and Indiana corporation not - for - profit organized for the purpose of effecting such refinancing,
<br />and the leasing of the Parking Facilities from Corporation to the City at rentals sufficient to
<br />retire revenue bonds issued by the Corporation for the purpose of acquiring the Parking Faciliti
<br />and
<br />WHEREAS, OF THE City have caused to be prepared a form of Lease Agreement ( "Lease ") between
<br />the Corporation as lessor and the City as lessee, the terms of which Lease have been agreed upon
<br />by the Corporation andofficers of the City; and
<br />WHEREAS, a petition requesting such refinancing and leasing, signed by not less than 50 tax-
<br />paying citizens of the City, has been filed with the Mayor and this Common Council; and
<br />WHEREAS, it is necessary that a public hearing be held as provided by Indiana Code 18- 5 -3.3-
<br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana that
<br />a public hearing shall be held on April- 24, 1978 on the necessity for the execution of the Lease
<br />and the fairness and the reasonableness of the rentals provided therein, and the City Clerk shal
<br />give notice of such hearing in the manner provided in Indiana Code 18- 5- 3.3 -7.
<br />A public hearing was held at this time on this resolution. Mr. Michael Vance, Deputy Controller
<br />indicated this resolution authorized the conveyance of the parking garages to a not - for - profit
<br />corporation, who will lease them back to the City of South Bend. He said this resolution does
<br />not authorize the lease, it only directs the City 'Clerk to advertise this proposed ordinance
<br />for public hearing. Council Member Dombrowski made a motion to adopt the resolution, seconded
<br />by Council Member Miller. The resolution was adopted by a roll call vote of eight ayes.

<br />This bill had first reading. Council Member Miller made a motion to refer this bill, and petiti
<br />to Area Plan, seconded by Council Member Adams. The motion carried.
<br />BILL NO. 29 -78 A BILL AMENDING AND SUPPLEMENTING CHAPTER 6 OF THE MUNICIPAL CODE
<br />OF SOUTH BEND, INDIANA, GENERALLY KNOWN AS THE BUILDING CODE OF
<br />THE CITY OF SOUTH BEND, INDIANA, BY ADDING PROVISIONS RELATIVE TO
<br />FLOOD PLAIN REGULATIONS.
<br />This bill had first reading. Council Member Miller made a motion to set this bill for public
<br />hearing and second reading April 24, 1978, seconded by Council Member Dombrowski. The motion
<br />carried.
<br />BILL NO. 30 -78 A'BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST INDENTURE
<br />AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THE
<br />EXECUTION THEREOF PERTAINING TO THOMAS S. DREISBACH AND LORIE
<br />DREISBACH.
<br />This bill had first reading. Council Member Miller made a motion to set this bill for public
<br />hearing and second reading April 24, 1978, seconded by Council Member Adams. The motion carried.
<br />BILL NO. 31 -78 A BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST INDENTURE
<br />AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THE
<br />EXECUTION THEREOF PERTAINING TO ROBERT JOHN DENOOYER AND ANITA RUTH
<br />DENOOYER AND JERRY LEE DENOOYER AND JOANNE GRACE DENOOYER.
<br />This bill had first reading. Council Member Miller made a motion to set this bill for public
<br />hearing and second reading April 24, 1978, seconded by Council Member Adams. The motion carried.
<br />BILL NO. 32 -78 A BILL REVISING ORDINANCE NO. 5544 -73, PERTAINING TO PARK RULES AND
<br />REGULATIONS.
<br />This bill had first reading. Council Member Miller made a motion to set this bill for public
<br />hearing and second reading April 24, 1978, seconded by Council Member Adams. Council Member
<br />Adams asked Mr. Parker, Deputy City Attorney, to ascertain if the title of this bill was correct.
<br />The motion carried.
<br />BILL NO. 33 -78 A BILL APPROPRIATING INTEREST EARNED FROM THE PURCHASE OF CERTIFICATES
<br />OF DEPOSIT OUT OF THE PROCEEDS OF THE 1977 PARK DISTRICT BONDS TO THE
<br />PARK DISTRICT BOND CONSTRUCTION FUND 50 IN THE AMOUNT OF $88,000.00.
<br />This bill had first reading. Council Member Miller made a motion to set this bill for public
<br />hearing and second reading April 24, 1978, seconded by Council Member Dombrowski. The motion
<br />carried.
<br />BILL NO. 34 -78 A BILL AMENDING CHAPTER 20,.ARTICLE 3, ABANDONED VEHICLES OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND.
