REGULAR MEETING SEPTEMBER 27, 1976 REGULAR MEETING (RECONVENED) ORDINANCE NO. 6045 -76 AN ORDINANCE APPROPRIATING $36,000 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING FOR VARIOUS PUBLIC SAFETY PROGRAMS, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROGUH THE BUREAU OF SUBSTANDARD BUILDINGS. This ordinance had second reading. Council Member Dombrowski made a motion to pass this ordinan seconded by Council Member Taylor. The ordinance passed by a roll call vote of nine ayes (Counc Members Serge, Szymkowiak, Miller, Taylor, Kopczynski, Adams, Dombrowski, Horvath and Parent). ORDINANCE NO. 6046 -76 AN ORDINANCE APPROPRIATING $41,864.28 FROM THE CUMULATIVE SEWER BUILDING AND SINKING FUND TO THE GENERAL IMPROVEMENT FUND. This ordinance had second reading. Council Member Miller made a motion to amend this ordinance as amended in the Committee of the Whole, seconded by Council Member Dombrowski. Council Member Adams made a motion to pass the ordinance, as amended, seconded by Council Member Taylor. The ordinance passed by a roll call vote of nine ayes (Council Members Serge, Szymkowiak, Miller, Taylor, Kopczynski, Adams, Horvath and Parent). ORDINANCE NO. 6047 -76 AN ORDINANCE APPROPRIATING $28,000.00 FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND FOR REPAIRS AND RENOVATION OF A PORTION OF THE RETAINING WALL ALONG THE ST. JOSEPH RIVER. TO BE ADMINISTERED BY THE DEPARTMENT OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA. This ordinance had second reading. Council Member Taylor made a motion to pass this ordinance, seconded by Council Member Miller. The ordinance passed by a roll call vote of nine ayes (Counc Members Serge, Szymkowiak, Miller, Taylor, Kopczynski, Adams, Horvath and Parent). ORDINANCE NO. 6048 -76 AN ORDINANCE APPROPRIATING $54,000.00 FROM THE LOCAL ROADS AND STREETS FUND AND $6,000.00 FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND TO PROJECT R & S 89 -1976, COLFAX AVENUE BRIDGE. This ordinance had second reading. Council Member Miller made a motion to pass this ordinance, seconded by Council Member Taylor. RESOLUTIONS RESOLUTION NO. 535 -76 A RESOLUTION OF THE COMMON COUNCIL OF SOUTH BEND APPROVING THE URBAN RENEWAL PLAN TOGETHER WITH THE PROPOSED AMENDMENTS THERETO AND PLAN CHANGES FOR LASALLE PARK PROJECT, INDIANA R -57. WHEREAS, under the provisions of Title I of the Housing Act of 1949, as amended, the Depart ment of Housing and Urban Development Administator is authorized to provide financial assistance to Local Public Agencies for undertaking and carryi.n_q out urban renewal projects; and WHEREAS, it is provided in such Act that contracts for financial aid thereunder require that the Urban Renewal Plan for the project area be approved by the governing body of the locality in which the project is situated and that such approval include findings by the governing body that: (1) the financial aid to be provided in the contract is necessary to enable the project to be undertaken in accordance with the Urban Renewal Plan; (2) the Urban Renewal Plan will afford maximum opportunity, consistent with the sound needs of the locality as a whole, for the rehabil- itation or redevelopment of the urban renewal area by private enterprise; (3) the Urban Renewal Plan conforms to a general plan for the development of the locality as a whole; and (4) the Urban Renewal Plan gives due consideration to the provision of adequate park and recreational areas and facilities, as may be desirable for neighborhood improvement, with special considera- tion for the health, safety and welfare of children residing in the general vicinity of the site covered by the Plan; and WHEREAS, the City of South Bend, Department of Redevelopment (herein called the "Local Publ: Agency "), has entered into a planning contract for financial assistance under such Act with the United States of America, acting by and through the Secretary of Housing and Urban Development, pursuant to which Federal funds were provided for the urban renewal project (herein called the "Project "), identified as "LaSalle Park Project, Indiana R -57" and encompassing the area bounded by a line drawn as follows: Beginning at the point of intersection of the north right -of -way line of Linden Avenue and a line which is an extension of the west right -of -way line of the alley between the parallel to Sheridan Avenue and Chicago Street; proceed east along the north right -of -way line of Linden Avenue to a point 129.0 feet, more or less, east of the east right -of -way line of Falcon Street; thence south along a line which is 129.0 feet, more or less, east of and parallel to the east right -of -way line of Falcon Street, a distance of 388.3 feet, more or less; thence at 90 degrees in a westerly direction a distance of 129.0 feet, more or less, to the east right -of -way line of Falcon Street; thence south along said right -of -way line a distance of 485.7 feet, more or less; thence at 90 degrees in an easterly direction a distance of 129.0 feet, more or less, to thevest right -of -way line of the alley between and parallel to falcon Street and Lake Street; thence south along said alley right -of -way line a distance of 116.0 feet, more or less; thence at 90 degrees in an easterly direction a distance of 203.0 feet, more or less, to the east right -of -way line of Lake Street; thence south along said right -of -way line a distance of 50.0 feet, more or less; thence at 90 degrees in an easterly direction a distance of 793.0 feet, more or less
