REGULAR MEETING OCTOBER 6 1975 <br />IIREGULAR MEETING - RECONVENED (CONTINUED) <br />(PETITION TO AMEND ZONING ORDINANCE (CONTINUED) <br />3. A legal description of the property is as follows: <br />Part of the South East 1/4 of Section 2, Township 37 North, <br />Range 2 East, Portage Township, St. Joseph County, Indiana, <br />described as follows: <br />A parcel of land in the St. Joseph County Agriculture Society <br />Addition designated as Lots 1 through 3 bounded by Portage <br />Avenue on the Northeast; Lindsey Street on the South; and <br />Leland Avenue on the West. <br />A parcel of land in the Chapin Place First Plat designated <br />as Lots 18 and 19, located on the Northwest corner of Forest <br />Avenue and Portage Avenue. <br />A parcel of land in the C. Fassnacht Addition designated as <br />Lots 4 through 8 located on the Southeast corner of Lamont <br />Terrace and Portage Avenue. <br />A parcel of land in the Fred Keller's Subdivision designated <br />as Lots 1, 2 and 12, also a parcel of land in the Burrough's <br />Subdivision designated as Lots 28 through 31. This is located <br />on the Southwest corner of Lindsey Street and Portage Avenue. <br />4. It is desired and requested that the foregoing property be rezoned <br />from "C" Commercial Use and "E" Height and Area District to "B" <br />Residential Use and "A" Height and Area District. <br />5. It is proposed that the property will be put to the following use <br />and the following building(s) will be constructed (include number <br />of dwelling units if residential): <br />The property will continue to be used as it is currently <br />occupied. <br />6. Serge <br />Petition Prepared by <br />Area Plan Commission <br />Council President Parent indicated that action on the petition would be taken when the ordinance <br />pertaining to it had first reading. <br />ORDINANCES, SECOND READING <br />ORDINANCE NO. 5894 -75 <br />AN ORDINANCE APPROVING;THE FORM AND TERMS <br />OF LEASE AND TRUST INDENTURE AND INDUSTRIAL <br />DEVELOPMENT REVENUE BONDS, AND AUTHORIZING <br />THE EXECUTION THEREOF PERTAINING TO NORMAN F. <br />ERNSBERGER - LAVERN D. JESSUP, A GENERAL <br />PARTNERSHIP. <br />This ordinance had second reading. Councilman Taylor made a motion to amend the lease and trust <br />indenture as amended in the Committee of the Whole, seconded by Councilman Newburn. The motion <br />carried. Councilman Taylor then made a motion to pass the ordinance, seconded by Councilman <br />Newburn. The ordinance passed by a roll call vote of nine ayes (Councilmen Serge, Szymkowiak, <br />Miller, Taylor, Kopczynski, Horvath, Nemeth, Newburn and Parent). <br />ORDINANCE NO. 5895 -75 AN ORDINANCE APPROVING THE FORM AND TERMS <br />OF LEASE AND TRUST INDENTURE AND INDUSTRIAL <br />DEVELOPMENT REVENUE BONDS, AND AUTHORIZING <br />THE EXECUTION THEREOF PERTAINING TO <br />HAMILTON MANUFACTURING AND WAREHOUSE, INC. <br />This ordinance had second reading. Councilman Serge made a motion to pass the ordinance, seconded <br />by Councilman Szymkowiak. The ordinance passed by a roll call vote of nine ayes (Councilmen Serge, <br />Szymkowiak, Miller, Taylor, Kopczynski, Horvath, Nemeth, Newburn and Parent). <br />ORDINANCE NO. 5896 -75 <br />AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, <br />AS AMENDED, COMMONLY KNOWN AS THE ZONING <br />ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA <br />(CHAPTER 21, MUNICIPAL CODE) - southeast <br />corner of Thomas and Walnut Streets. <br />This ordinance had second reading. Councilman Szymkowiak made a motion to pass the ordinance, <br />seconded by Councilman Newburn. The ordinance passed by a roll call vote of nine ayes (Councilmen <br />Serge, Szymkowiak, Miller, Taylor, Kopczynski, Horvath, Nemeth, Newburn and Parent). <br />
