REGULAR MEETING SEPTEMBER 81 1975 IREGULAR MEETING - RECONVENED Be it remembered that the regular meeting of the Common Council of the City of South Bend reconvened in the Council Chambers at 7:15 p.m., Council President Parent presiding and nine members present. IREPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would respectfully report that it has inspected the minutes of the August 25, 1975, regular meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. s/ Roger O. Parent Councilman Kopczynski made a motion that the report be accepted as read and placed on file and the minutes be approved, seconded by Councilman Horvath. The motion carried. REPORT FROM THE COMMITTEE OF THE WHOLE Councilman Kopczynski made a motion to waive the reading of'the report of the Committee of the Whole, seconded by Councilman Newburn. The motion carried by a roll call vote of nine ayes (Councilmen Serge, Szymkowiak, Miller, Taylor, Kopczynski, Horvath, Nemeth, Newburn and Parent). REPORT FROM THE DIRECTOR OF THE DEPARTMENT OF PUBLIC SAFETY Mr. Michael Carrington, Director of the Department of Public Safety, introduced Mr. Bert Cichowicz, Manager of the Bureau of Weights and Measures. Mr. Cichowicz briefly explained the operation of his bureau and its importance to the consumer. He indicated that the primary purpose of the Weights and Measures Department was to safeguard the entire public in all matters involving the determination of quantity. This was done by seeing to it that, whatever merchandise was sold or purchased, a just weight and measure was given. He talked about supervision over the phase of misrepresentation. He cited examples of complaints dealing with false and misleading advertising. He indicated that attempts had been made to correct the situations in the various stores in the community. He stated that, when the names of the stores were printed in the South Bend Tribune, the problems had been rectified. Councilman Szymkowiak wondered if the ads appearing in the news- papers were spot checked before complaints were received. Mr. Cichowicz indicated that each com- plaint was checked and, if time permitted, the ads were checked even though there were no complain He indicated that this, however, was a very difficult thing to do because the ads appeared so regularly. Councilman Szymkowiak felt every violator of the law should be publicized and named in an effort to stop the violations. He complimented Mr. Cichowicz on the fine job he was doing. Councilman Kopczynski also commended Mr. Cichowicz for the conscientious job he was doing, and Council President Parent agreed. (ORDINANCES, SECOND READING ORDINANCE NO. 5882 -75 AN ORDINANCE APPROPRIATING THE SUM OF $100,000.00 FROM THE SEWAGE WORKS IMPROVEMENT FUND FOR STEP TWO OF THE LABORATORY RENOVATION AND ENLARGEMENT. This ordinance had second reading. Councilman Horvath made a motion to pass the ordinance, seconded by Councilman Serge. The ordinance passed by a roll call vote of nine ayes (Councilmen Serge, Szymkowiak, Miller, Taylor, Kopczynski, Horvath, Nemeth, Newburn and Parent). ORDINANCE NO. 5883 -75 AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) - LaSalle, Niles and Madison. This ordinance had second reading. Councilman Kopczynski made a motion to pass the ordinance, seconded by Councilman Serge. The ordinance passed by a roll call vote of nine ayes (Councilmen Serge, Szymkowiak, Miller, Taylor, Kopczynski, Horvath, Nemeth, Newburn and Parent). ORDINANCE AN ORDINANCE PROVIDING FOR THE RECEIVING AND CONVEYING OF A GIFT OF REAL PROPERTY TO THE CIVIL CITY OF SOUTH BEND, INDIANA. Council President Parent asked Mr. James Seitz, Director of the Department of Public Parks, if he was aware of the matter and could make some sort of a presentation on the matter. Mr. Seitz indicated that he was not prepared to make such a presentation. Councilman Nemeth made a motion to continue the ordinance to the September 22, 1975, meeting of the Council, seconded by Councilman Taylor. The motion carried. ORDINANCE NO. 5884 -75 AN ORDINANCE APPROPRIATING THE SUM OF $4,000.00 FROM THE PARKING METER FUND TO ACCOUNT NO. 430.0, "REPAIR PARTS ", OF THE PARKING METER BUDGET FOR 1975 OF THE CITY OF SOUTH BEND, INDIANA. This ordinance had second reading. Councilman Newburn made a motion to pass the ordinance, seconded by Councilman Kopczynski. The ordinance passed by a roll call vote of nine ayes (Councilmen Serge, Szymkowiak, Miller, Taylor, Kopczynski, Horvath, Nemeth, Newburn and Parent).
