s"- s <br />REGULAR MEETING DECEMBER 51 1983 <br />amount of the bonds, for completion of the Project and for additions to the Project, <br />including the costs of issuance (providing that the financing of such addition or <br />additions to the Project is found to have a public purpose (as defined in I.C. 36 -7- <br />12-1) at the time of authorization fo such additional bonds), and that the aforementioned <br />purposes comply with the provisions of L.C. 36 -7 -12. <br />4. All costs of the Project incurred after the adoption of this inducement <br />resolution, including reimbursement or repayment to the Applicant of moneys expended <br />by the Applicant for planning, engineering, interest paid during construction, underwriti <br />expenses, attorney and bond counsel fees, acqusition, construction and equipping of <br />the Project will be permitted to be included as part of the bond issue to finance the <br />Project, and the Issuer will sell or lease the same to the Applicant or loan the <br />proceeds from the sale of the bonds to the Applicant for the same purposes. Also, <br />certain indirect expenses, including but not limited to, planning, architectural work <br />and engineering incurred prior to this inducement resolution will be permitted to be <br />included as part of the bond issue to finance the Project. <br />/s/ Beverlie D. Fred Baer, attorney for <br />the petitioner, indicated they planned to construct an addition to the existing facilities <br />He indicated that approximately six to twelve jobs will be created. Council Member <br />Szymkowiak made a motion to adopt this resolution, seconded by Council Member Taylor. <br />The resolution was adopted by a roll call vote of nine ayes. <br />RESOLUTION NO. 1105 -83 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION <br />DESIGNATING CERTAN AREAS WITHIN THE CITY OF SOUTH BEND, <br />COMMONLY KNOWN AS 850 SOUTH MARIETTA STREET TO BE AN ECONOMIC <br />REVITALIZATION AREA FOR PURPOSES OF TAX ABATEMENT. <br />WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory <br />Resolution designating certain areas within the City as Economic Revitalization Areas <br />for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as 850 <br />Marietta Street and more particularly described by a line drawn as follows: <br />LEGAL DESCRIPTION <br />MONROE SAMPLE PARCEL NO. 10 <br />Lots Numbered 120, 121, 122 and 123 in Edward H. Rush's First Addition t the City of <br />South Bend, Plat Book 7, page 8 and Lots Numbered 37, 38, 39, 40 and 41 and a portion <br />of Lot 42, all in Rachel Gallagher's First Addition to the City of South Bend, Indiana, <br />Plat Book 5, page 22, and Lots Numbered 10, 11, 12 and portions of Lots 9, 13 and 14, <br />11 in Plat of Frantz' 3rd Addition to the City of South Bend, Indiana, Plat Book 5, <br />page 17 and Lot 14 and a portion of Lot 15, both in Plat of Frantz' 2nd Addition to <br />the City of South Bend, Plat Book 5, page 9.
