S" e':' 0 REGULAR MEETING DECEMBER 5, 1983 3. That it is hereby found and determined that the Plan, as amended, for the Area conforms to the master plan of development for the City of South Bend. 4. That it is hereby found and determined that the Plan, as amended, for the Area will afford maximum opportunity, consistent with the sound needs of the City of South Bend as a whole, for the redevelopment of the Area by private enterprise in concert with the Department. 5. That it is hereby found and determined that the Plan, as amended, for the Area gives due consideration to the provision of adequate park and recreational areas and facilities, as may be desirable for neighborhood improvement, with special consideration for the health, safety, and welfare of childlren residing in the general vicinity of the Area. 6. That the Declaratory Resoluton of the Commission and the Plan, as amended, are hereby in all rspects approved. 7. That, in order to implement land facilitate the Plan hereby approved, it is found and determined that certain official action must be taken by the City of South Bend with reference, among other things, to changes in zoning, vacation and removal of streets, alleys and other public ways, the establishment of new street patterns, the location and relocation of sewer and water mains and other public facilities, and other public actions, and accordingly, the Common Council hereby (2) pledges its cooperation in helping to carry out such Plan; (b) requests the varius officials, departments, boards, and agencies of theCity of South Bend having administrative responsibilities to likewise cooperate to such end and to exercise their respective functions and powers in a manner consistent with the Plan; and (c) stands ready to consider and take appropriate action upon proposals and measures designed to effectuate the Plan, as amended. 8. That the United States of America be, and hereby is assured of full compliance by the City of South Bend with the provisions ofTitle VI of the Civil Rights Act of 1964, as amended, and the regulations of the Department of Housing and Urban Development effectuating that Title. 9. That this resolution shall be in full force and effect from and aftger its adoption by the Common Council and approval by the Mayor. /s/ Beverlie D. Ann Kolata, Deputy Director, of Redevelopment, indicated this resolution expanded the Urban Renewal Area to include the building located on the northeast corner of Lasalle and Michigan Streets, as well as expanded the allocation area for purposes of tax incremental financing to include the entire Urban Renewal Area, and changed the structure of the Design Review Committee to include a core committee of five members plus two representatives from the Central Downtown Urban Renewal Area. Council Member Serge made a motion to adopt this resolution, seconded by Council Member Harris. The resolution was adopated by a roll call vote of nine ayes. BILLS, FIRST READING BILL NO. 132 -83 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) AND ORDINANCE NO. 6743- 80 (PROPERTY LOCATED ON WASHINGTON STREET, BETWEEN SUMMITT DRIVE AND LOMBARDY DRIVE.) This bill had first reading. Council Member Taylor made a motion to this bill to Area Plan, seconded by Council Member McGann. The motion carried. BILL NO. 133 -83 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE EAST. -WEST ALLEY IN THE BLOCK BOUNDED BY MINER STREET ON THE NORTH, CEDAR STREET ON THE SOUTH, ST. PETER STREET ON THE EAST AND ST. LOUIS STREET ON THE WEST, ALL LOCATED IN M. E. LISTENBERGER'S SUBDIVISION OF LARGE LOT OR BLOCK NUMBERED THREE (3) IN SAMUEL CONTTRELL'S FIRST ADDITION TO THE TOWN OF LOWELL, NOW A PART OF THE CITY OF SOUTH BEND, IN ST. JOSEPH COUNTY, INDIANA. This bill had first reading. Council Member Taylor made a motion to set this bill for public hearing and second reading January 9, 1984, and refer it to the Zoning and Vacation Committee, seconded by Council Member.Zielinski. The motion carried. BILL N0, 134 -83 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE EAST WEST ALLEY IN THE HALF BLOCK BOUNDED BY SOUTH BEND AVENUE ON THE NORTH, CEDAR STREET ON THE SOUTH, ST. LOUIS STREET ON THE EAST AND THE NORTH -SOUTH ALLEY APPROXIMATELY HALF WAY BETWEEN SOUTH BEND AVENUE AND CEDAR STREET ON THE WEST, ALL LOCATED IN BULLA'S ADDITION TO THE TOWN OF LOWELL, NOW A PART OF THE CITY OF SOUTH BEND, IN ST. JOSEPH COUNTY, INDIANA.
