REGULAR MEETING MARCH 28, 1983 REGULAR MEETING RECONVENED Be it remembered that the Common Council of the city of South Bend reconvened in the Council Chambers on the fourth floor of the County -City Building at 8:03 p.m. Council President Beck presiding and nine members present. ORDINANCE NO. 7175 -83 AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (OLIVE - SAMPLE AREA.) This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Harris. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 7176 -83 AN ORDINANCE APPROPRIATING $2,945,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE DIVISION OF COMMUNITY DEVELOPMENT OF THE CITY OF SOUTH BEND, INDIANA, AND DESIGNATED SUBGRANTEE AGENCIES FOR THE PROGRAM YEAR BEGINNING APRIL 1, 1983 AND ENDING DECEMBER 31, 1983 TO BE ADMINISTERED THROUGH THE DIVISION OF COMMUNITY DEVELOPMENT. This bill had second reading. Council Member Taylor made a motion to pass this bill, seconded by Council Member Serge. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 7177 -83 AN ORDINANCE TRANSFERRING $1,552,246.00 AMONG VARIOUS ACCOUNTS, ALL ACCOUNTS BEING WITHIN THE DIVISION OF COMMUNITY DEVELOPMENT. This bill had second reading. Council Member Taylor made a motion to amend this bill, as amended in the Committee of the Whole, seconded by Council Member Zielinski. The motion carried. Council Member Taylor made a motion to pass the bill, as amended, seconded by Council Member Harris. The bill passed by a roll call vote of nine ayes. ORDIANNCE NO. 7178 -83 AN ORDINANCE APPROVING A CONTRACT BETWEEN GATES CHEVY WORLD OF SOUTH BEND AND THE BOARD OF WATER WORKS COMMISSIONERS IN THE AMOUNT OF $19,555.19 FOR THE REPLACEMENT OF TWO VEHICLES IN THE DISTRIBUTION DEPARTMENT AND ONE (1) IN THE MAINTENANCE DEPARTMENT OF THE WATER WORKS. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Taylor. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 7179 -83 AN ORDINANCE APPROVING A CONTRACT BETWEEN CARL J. REINKE & SONS, INC., AND THE BOARD OF WATER WORKS COMMISSIONERS IN THE AMOUNT OF $148,000.00 FOR THE CONSTRUCTION OF A ONE -HALF MILLION GALLON CLEAR WELL AT THE EDISON PARK WATER FILTRATION PLANT. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Szymkowiak. The bill passed by a roll call vote of nine ayes. RESOLUTIONS RESOLUTION NO. 1037 -83 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND APPROVING THE EAST BANK DEVELOPMENT PLAN, AS AMENDED, AND FURTHER AMENDING THE DEVELOPMENT PLAN. WHEREAS, the City of South Bend Redevelopment Commission ( "Commission "), pursuant to the Redevelopment of Cities and Towns Act of 1953, as amended (36 -7 -14) (the "Act "), has conducted surveys and investigations and has thoroughly studied the area in the City of South Bend, County of St. Joseph, State of Indiana, and designated the area as the "East Bank Development Area: (the "Area "), which Area is more particularly described as follows: A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows, viz: Beginning at the point of intersection of the North - right -of -way line of Sorin Street with the East right -of -way line of Niles Avenue in said City; thence South along said East right -of -way line of Niles Avenue to the centerline of the first fourteen (14) foot alley lying North of Cedar Street and between Niles Avenue and Hill street; thence East along said centerline, to the centerline of Hill Street, a sixty six (66) foot right -of -way; thence South, along said Hill Street centerline, to the centerline of Jefferson Boulevard; an eight -two and one -half (82.5) foot right -of -way; thence West, along said Jefferson Boulevard centerline to the center of the St. Joseph River; thence in a Northwesterly and Northeasterly direction along the centerline of said River to its intersection with the projected North right -of -way line of said Sorin Street; thence East, along said projection and-along said North right -of -way line to the East right - of -way line of Niles Avenue which is the place of beginning.
