REGULAR MEETING NOVEMBER 23, 1981 <br />REGULAR MEETING RECONVENED <br />Be it remembered that the Common Cuncil of the City of South Bend reconvened in the <br />Council Chambers on the fourth floor of the County -City Building at 9:21 p.m. Council <br />President McGann Presiding and nine members present. <br />BILLS, SECOND READING <br />ORDINANCE NO. 6999 -81 <br />AN ORDINANCE TRANSFERRING $306,691.71 FROM THE CUMULATIVE <br />CAPITAL IMPROVEMENT FUND TO THE POLICE DEPARTMENT WITHIN THE <br />GENERAL IMPROVEMENT FUND OF THE CITY OF SOUTH BEND, INDIANA. <br />This bill had second reading. Council Member Taylor made a motion to pass the bill, <br />seconded by Council Member Dombrowski. The bill passed by a roll call vote of eight <br />ayes. <br />ORDINANCE NO. 7000 -81 AN ORDINANCE APPROPRIATING $43,445.00 TO THE BUREAU OF <br />SEWERS BUDGET LINE ITEM 260 CONTRACTUAL SERVICES FROM THE <br />SEWAGE WORKS DEPRECIATION FUND FOR EMERGENCY SEWER REPAIRS <br />ON SAMPLE STREET AT THE RAILROAD CROSSING EAST TO THE FIRE <br />STATION. <br />This bill had second reading. Council Member Taylor made a motion to pass the bill, <br />seconded by Council Member Dombrowski. The bill passed by a roll call vote of eight <br />ayes. <br />ORDINANCE NO. 7001 -81 <br />AN ORDINANCE APPROPRIATING $18,000.00 TO ACCOUNT 260, <br />CONTRACTUAL SERVICES, WITHIN THE BUREAU OF WATER BUDGET OF <br />THE WATER WORKS GENERAL FUND FOR THE DESIGN OF ADDITIONAL <br />WATER STORAGE AT THE EDISON PLANT AND APPROVING THE AWARD OF <br />A CONTRACT FOR SAID DESIGN BETWEEN THE BOARD OF WATER WORKS <br />COMMISSIONERS AND MCDONOUGH ENGINEERING, INC. <br />This bill had second reading. Council Member Serge made a motion to pass the bill, <br />seconded by Council Member Dombrowski. The bill passed by a roll call vote of eight <br />ayes. <br />ORDINANCE NO. 7002 -81 <br />AN ORDINANCE APPROVING A CONTRACT BETWEEN STREMMEL & HILL, <br />INC., AND THE BOARD OF WATER WORKS COMMISSIONERS IN THE <br />AMOUNT OF $113,985.00 FOR THE REPLACEMENT OF MEDIA AND <br />REPAIR OF FILTER NOZZLES AT THE EDISON FILTRATION. <br />This bill had second reading. Council Member Serge made a motion to pass the bill, <br />seconded by Council Member Dombrowski. The bill passed by a roll call vote of eight <br />ayes. <br />RESOLUTIONS <br />RESOLUTION NO.928 -81 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREA WITHIN THE CITY OF SOUTH <br />BEND, COMMONLY KNOWN AS 1120 W. SAMPLE TO BE AN URBAN <br />DEVELOPMENT AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT <br />AND A DETERMINATION OF THE PUBLIC UTILITY AND BENEFIT OF THE <br />PROJECT PROPOSED FOR TAX ABATEMENT CONSIDERATION. <br />WHEREAS, the Common Council of South Bend has adopted a Declaratory Resolution <br />designating certain areas within the City as Urban Development Areas for purposes of <br />tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designating the area commonly known as 1120 <br />West Sample and more particularly described by a line drawn as follows: <br />A parcel of land being a part of the North Half of Section 14, Township 37 North, <br />Range 2 East, in Portage Township, City of South Bend, St. Joseph County, Indiana, <br />and being more particularly described as follows, viz: <br />Beginning at the intersection of the South line of Garst Street with the westerly <br />line of Prairie Avenue in said City; said intersection being the most northeasterly <br />corner of a parcel of land Quit - claimed to Metal Resources Corporation by Penn Central <br />Corporation in document numbered 8103153 in the Office of the Recorder of St. Joseph <br />County, Indiana; thence North 890- 46' -31" West, along the South line of Garst Street <br />and said South line projected, said line being a northerly line of said Quit - claimed <br />parcel, a distance of 582.58 feet to the East line of the Northwest Quarter of said <br />Section 14; thence North 890- 58' -10" West, along a northerly line of said Quit - claimed <br />parcel a distance of 504.59 feet to the most northeasterly corner of a parcel of land <br />deeded to Metal Resources Corporation by Albert Davidson in document numbered 8101507 <br />in said Recorder's Office; thence continuing North 890 - 58'10" West, along the northerly <br />line of said Davidson parcel a distance of 201.61 feet; thence South 670- 39' -57" <br />West, along the northwesterly line of said Davidson parcel, a distance of 330.91 <br />feet; thence South 00- 07' -28" West, along the westerly line of said Davidson parcel, <br />a distance of 1108.76 feet to a northerly corner of a parcel of land deeded to Shirley <br />R.
