REGULAR MEETING NOVEMBER 23, 1981 REGULAR MEETING RECONVENED Be it remembered that the Common Cuncil of the City of South Bend reconvened in the Council Chambers on the fourth floor of the County -City Building at 9:21 p.m. Council President McGann Presiding and nine members present. BILLS, SECOND READING ORDINANCE NO. 6999 -81 AN ORDINANCE TRANSFERRING $306,691.71 FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND TO THE POLICE DEPARTMENT WITHIN THE GENERAL IMPROVEMENT FUND OF THE CITY OF SOUTH BEND, INDIANA. This bill had second reading. Council Member Taylor made a motion to pass the bill, seconded by Council Member Dombrowski. The bill passed by a roll call vote of eight ayes. ORDINANCE NO. 7000 -81 AN ORDINANCE APPROPRIATING $43,445.00 TO THE BUREAU OF SEWERS BUDGET LINE ITEM 260 CONTRACTUAL SERVICES FROM THE SEWAGE WORKS DEPRECIATION FUND FOR EMERGENCY SEWER REPAIRS ON SAMPLE STREET AT THE RAILROAD CROSSING EAST TO THE FIRE STATION. This bill had second reading. Council Member Taylor made a motion to pass the bill, seconded by Council Member Dombrowski. The bill passed by a roll call vote of eight ayes. ORDINANCE NO. 7001 -81 AN ORDINANCE APPROPRIATING $18,000.00 TO ACCOUNT 260, CONTRACTUAL SERVICES, WITHIN THE BUREAU OF WATER BUDGET OF THE WATER WORKS GENERAL FUND FOR THE DESIGN OF ADDITIONAL WATER STORAGE AT THE EDISON PLANT AND APPROVING THE AWARD OF A CONTRACT FOR SAID DESIGN BETWEEN THE BOARD OF WATER WORKS COMMISSIONERS AND MCDONOUGH ENGINEERING, INC. This bill had second reading. Council Member Serge made a motion to pass the bill, seconded by Council Member Dombrowski. The bill passed by a roll call vote of eight ayes. ORDINANCE NO. 7002 -81 AN ORDINANCE APPROVING A CONTRACT BETWEEN STREMMEL & HILL, INC., AND THE BOARD OF WATER WORKS COMMISSIONERS IN THE AMOUNT OF $113,985.00 FOR THE REPLACEMENT OF MEDIA AND REPAIR OF FILTER NOZZLES AT THE EDISON FILTRATION. This bill had second reading. Council Member Serge made a motion to pass the bill, seconded by Council Member Dombrowski. The bill passed by a roll call vote of eight ayes. RESOLUTIONS RESOLUTION NO.928 -81 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREA WITHIN THE CITY OF SOUTH BEND, COMMONLY KNOWN AS 1120 W. SAMPLE TO BE AN URBAN DEVELOPMENT AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT AND A DETERMINATION OF THE PUBLIC UTILITY AND BENEFIT OF THE PROJECT PROPOSED FOR TAX ABATEMENT CONSIDERATION. WHEREAS, the Common Council of South Bend has adopted a Declaratory Resolution designating certain areas within the City as Urban Development Areas for purposes of tax abatement consideration; and WHEREAS, a Declaratory Resolution designating the area commonly known as 1120 West Sample and more particularly described by a line drawn as follows: A parcel of land being a part of the North Half of Section 14, Township 37 North, Range 2 East, in Portage Township, City of South Bend, St. Joseph County, Indiana, and being more particularly described as follows, viz: Beginning at the intersection of the South line of Garst Street with the westerly line of Prairie Avenue in said City; said intersection being the most northeasterly corner of a parcel of land Quit - claimed to Metal Resources Corporation by Penn Central Corporation in document numbered 8103153 in the Office of the Recorder of St. Joseph County, Indiana; thence North 890- 46' -31" West, along the South line of Garst Street and said South line projected, said line being a northerly line of said Quit - claimed parcel, a distance of 582.58 feet to the East line of the Northwest Quarter of said Section 14; thence North 890- 58' -10" West, along a northerly line of said Quit - claimed parcel a distance of 504.59 feet to the most northeasterly corner of a parcel of land deeded to Metal Resources Corporation by Albert Davidson in document numbered 8101507 in said Recorder's Office; thence continuing North 890 - 58'10" West, along the northerly line of said Davidson parcel a distance of 201.61 feet; thence South 670- 39' -57" West, along the northwesterly line of said Davidson parcel, a distance of 330.91 feet; thence South 00- 07' -28" West, along the westerly line of said Davidson parcel, a distance of 1108.76 feet to a northerly corner of a parcel of land deeded to Shirley R. Steinmetz, et al, in document numbered 7903987 in said Recorder's Office, said corner being the point of tangency of a curve concave northwesterly, said curve having a radius of 272.37 feet and being subtended by a chord of 316.13 feet which bears South 350- 35' -57" West, said curve being the most westerly boundary of said Steinmetz 1 1 f 1
