r <br />REGULAR MEETING JULY 27, 19 81 <br />NOW, THEREFORE, BE IT RESOLVED THAT THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA: <br />SECTION I. Hereby authorizes the Division of Community Development to submit an <br />application to the United States Department of Housing and Urban Development to parti- <br />cipate in the Small Rental Rehabilitation Demonstration Project. <br />SECTION II. Hereby designates the Division of Community Development as the <br />administrative agent for the program. <br />SECTION III. Hereby indicates its willingness to appropriate funds as necessary <br />from the Community Development Block Grant to implement the demonstration program, if <br />the City's application is approved. <br />SECTION IV. This resolution shall be in full force and effect from and after <br />its adoption by the Common Council and approval by the Mayor. <br />/s /John Voorde <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Marzy Bauer, Director of <br />Community Development, indicated that the purpose of the demonstration is to encourage <br />cities to develop program to rehabilitate rental housing stock. She indicated the <br />City's proposal allows for the rehabilitation of a number (5 -15) of single- family <br />rental units owned and managed by one investor to be rehabilitated. Glendarae Hernandez, <br />702 E. South, indicated she would like to see this program in the the Monroe /Sample <br />area. Council Member Serge made a motion to adopt this resolution, seconded by Council <br />Member Beck. The resolution was adopted by a roll call vote of eight ayes. <br />RESOLUTION NO. 897 -81 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />APPROVING THE ISSUANCE OF A SCRAP DEALER'S LICENSE FOR <br />WEAVER TRUCK AND EQUIPMENT COMPANY. <br />WHEREAS, the Common Council of the City of South Bend recognizes the contri- <br />butions that recycling operations such as junk and scrap yards make to the community; <br />and the Council further realizes that such operatins must be reasonably regulated in <br />order to minimize any environmental or aesthetic nuisances which may be created by the <br />operations of scrap and junk yards within the city; and <br />WHEREAS, the Common Council of the City of South Bend has enacted reasonable <br />rules and regulations with regard to the issuance of licenses and the operations of <br />the scrap and junk dealers; and <br />WHEREAS, although Weaver Truck and Equipment is not considered a junk dealer <br />under the definition of same in Ordinance No. 6621 -79, the requirement for licensing <br />the premises as a scrap yard is based upon the nature of the articles stored on the <br />property rather than the specific nature of the business being conducted; and <br />WHEREAS, in accordance with the requirements of Ordinance No. 6621 -79, inspec- <br />tions of the premises are required to be completed by the Neighborhood Code Enforce- <br />ment Office and the Fire Prevention Bureau; and it has been determined that no code <br />violations exist on the property of Weaver Truck and Equipment Company, 3700 Gertrude <br />Street; and <br />WHEREAS, the Board of Public Works, at its meeting held on July 20, 1981, ap- <br />proved the issuance of a scrap dealer's license for Weaver Truck and Equipment Com- <br />pany, 3700 Gertrude Street, subject to approval of the Common Council. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. That the license application for Weaver Truck and Equipment Company, <br />3700 Gertrude Street, be approved based upon the favorable review of the property by <br />the Neighborhood Code Enforcement Office and the Fire Prevention Bureau in accordance <br />with the inspection reports attached hereto and made a part hereof as required by <br />Ordinance No. 6894 -81. <br />SECTION II. That this Resolution shall be in full force and effect from and <br />after its adoption by the Common Council and its approval by the Mayor. <br />/s/ John Voorde <br />Member of the Common Council <br />A public hearing was held on the resoltuion at this time. Kathy Barnard, Director of <br />Neighborhood Code Enforcement, indicated that the Board of Public Works had approved <br />the application for a license. She indicated that inspections of the property were <br />made by her department and the Fire Prevention Bureau, and they both gave favorable <br />recommendations. Council Member Serge made a motion to adopt this resolution, seconded <br />by Council Member Beck. The resolution was adopted by a roll call vote of eight ayes. <br />RESOLUTION NO. 898 -81 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, APPROVING THE AWARD OF THREE CONTRACTS IN <br />EXCESS OF $10,000.00 FOR THE REHABILITATION WORK IN THE <br />COMMUNITY DEVELPMENT PROGRAM THROUGH THE BUREAU OF HOUSING'S <br />REHABILITATION GRANT PROGRAM. <br />
