r REGULAR MEETING JULY 27, 19 81 NOW, THEREFORE, BE IT RESOLVED THAT THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I. Hereby authorizes the Division of Community Development to submit an application to the United States Department of Housing and Urban Development to parti- cipate in the Small Rental Rehabilitation Demonstration Project. SECTION II. Hereby designates the Division of Community Development as the administrative agent for the program. SECTION III. Hereby indicates its willingness to appropriate funds as necessary from the Community Development Block Grant to implement the demonstration program, if the City's application is approved. SECTION IV. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s /John Voorde Member of the Common Council A public hearing was held on the resolution at this time. Marzy Bauer, Director of Community Development, indicated that the purpose of the demonstration is to encourage cities to develop program to rehabilitate rental housing stock. She indicated the City's proposal allows for the rehabilitation of a number (5 -15) of single- family rental units owned and managed by one investor to be rehabilitated. Glendarae Hernandez, 702 E. South, indicated she would like to see this program in the the Monroe /Sample area. Council Member Serge made a motion to adopt this resolution, seconded by Council Member Beck. The resolution was adopted by a roll call vote of eight ayes. RESOLUTION NO. 897 -81 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND APPROVING THE ISSUANCE OF A SCRAP DEALER'S LICENSE FOR WEAVER TRUCK AND EQUIPMENT COMPANY. WHEREAS, the Common Council of the City of South Bend recognizes the contri- butions that recycling operations such as junk and scrap yards make to the community; and the Council further realizes that such operatins must be reasonably regulated in order to minimize any environmental or aesthetic nuisances which may be created by the operations of scrap and junk yards within the city; and WHEREAS, the Common Council of the City of South Bend has enacted reasonable rules and regulations with regard to the issuance of licenses and the operations of the scrap and junk dealers; and WHEREAS, although Weaver Truck and Equipment is not considered a junk dealer under the definition of same in Ordinance No. 6621 -79, the requirement for licensing the premises as a scrap yard is based upon the nature of the articles stored on the property rather than the specific nature of the business being conducted; and WHEREAS, in accordance with the requirements of Ordinance No. 6621 -79, inspec- tions of the premises are required to be completed by the Neighborhood Code Enforce- ment Office and the Fire Prevention Bureau; and it has been determined that no code violations exist on the property of Weaver Truck and Equipment Company, 3700 Gertrude Street; and WHEREAS, the Board of Public Works, at its meeting held on July 20, 1981, ap- proved the issuance of a scrap dealer's license for Weaver Truck and Equipment Com- pany, 3700 Gertrude Street, subject to approval of the Common Council. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the license application for Weaver Truck and Equipment Company, 3700 Gertrude Street, be approved based upon the favorable review of the property by the Neighborhood Code Enforcement Office and the Fire Prevention Bureau in accordance with the inspection reports attached hereto and made a part hereof as required by Ordinance No. 6894 -81. SECTION II. That this Resolution shall be in full force and effect from and after its adoption by the Common Council and its approval by the Mayor. /s/ John Voorde Member of the Common Council A public hearing was held on the resoltuion at this time. Kathy Barnard, Director of Neighborhood Code Enforcement, indicated that the Board of Public Works had approved the application for a license. She indicated that inspections of the property were made by her department and the Fire Prevention Bureau, and they both gave favorable recommendations. Council Member Serge made a motion to adopt this resolution, seconded by Council Member Beck. The resolution was adopted by a roll call vote of eight ayes. RESOLUTION NO. 898 -81 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING THE AWARD OF THREE CONTRACTS IN EXCESS OF $10,000.00 FOR THE REHABILITATION WORK IN THE COMMUNITY DEVELPMENT PROGRAM THROUGH THE BUREAU OF HOUSING'S REHABILITATION GRANT PROGRAM.
