REGULAR MEETING SEPTEMBER 15, 1980 <br />REGULAR MEETING RECONVENED (CONTINUED <br />A public hearing was held on the resolution at this time. Mr. Kenneth Fedder, attorney <br />for the Economic Development Commission, indicated there was an expansion of the business <br />on Taylor Street. He said five new jobs will be created. Council Member Szymkowiak <br />made a motion to adopt this resolution, seconded by Council Member Dombrowski. The <br />resolution was adopted by a roll call vote of nine ayes. <br />RESOLUTION NO. 818 -80 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, AUTHORIZING THE BOARD OF WORKS TO NEGOTITATE THE <br />SALE OF CITY -OWNED LOT LOCATED AT 233 ELDER.STREET. <br />WHEREAS, the Board of Public Works of theCity of South Bend pursuant to the Municipal <br />Code of the City of South Bend, Chapter 14.5, has offered for sale the following des- <br />cribed property: <br />Part of Lot "L" and part of the south 4 feet of Lot 21 of Elder Place <br />Addition to South Bend, described as follows: Beginning at the south- <br />west corner of said Lot "L" of Elder Place Addition; thence north 47 <br />feet; thence east 37.05 feet; thence south 47 feet; thence west 37.05 <br />feet to the place of beginning. <br />at an offering price of $361.00; and <br />WHEREAS, the Board of Public Works of the City of South Bend has now received -an offe <br />to purchase the property at 233 Elder Street for a price of $50.00; and <br />WHEREAS, the Board of Public Works has now complied with all requirements of the <br />Municipal Code of the City of South Bend, Chapter 14.5, which establishes procedures <br />for the disposition of real property owned by the City of South Bend, and more specificall <br />real property valued by the Board at less than $1,000.00. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend that: <br />SECTION I. The Board of Public Works be authorized-to negotiate a contract for the <br />sale of <br />Part of Lot "L" and part of the south 4 feet of Lot 21 of Elder Place <br />Addition to South Bend, described as follows: Beginning at the south- <br />west corner of said Lot "L" of Elder Place Addition; thence north 47 feet <br />thence east 37.05 feet; thence south 47 feet; thence west 37.05 feet to <br />the place of beginning, <br />for a total price of Fifth Dollars ($50.00). <br />SECTION II. This resolution shall be in full force and effect from and after its <br />adoption by the Common Council and approval by the Mayor. <br />/s /Lewis A. Mr. Patrick McMahon, Director <br />of Public Works, indicated that the next door neighbor had been taking care of this pro- <br />perty, and he has made an offer of $50 to purchase it. He said the $50 was all this <br />person could afford. CouncilMember Dombrowski made a motion to adopt this resolution, <br />seconded by Counci]Member Crone. The resolution was adopted by a roll call vote of nine <br />ayes. <br />RESOLUTION NO. 819 -80 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND APPROVING THE ISSUANCE OF A LICENSE FOR SCRAP AND <br />JUNK DEALER (BREMEN IRON AND METAL COMPANY, INC.) <br />WHEREAS, the Common Council of the City of South Bend recognizes the contr.ibutions:• <br />that recycling operations such as junk and scrap yards make to the community; and the <br />Council further _realizes that such operations must be reasonably regulated in order to <br />minimize any environmental or aesthetic nuisances which may created by the operations <br />of scrap and junk yards within the city; and <br />WHEREAS, the Common Council of the City of South bend has enacted reasonable rules <br />and regulations with regard to the issuance of licenses and the operation of the scrap <br />and junk dealers; and <br />WHEREAS, a petition by Bremen Iron and Metal Company, Inc., was submitted to the <br />Board of Public Works on August 18, 1980, for the operation of a waste metal scrap <br />operation on property located off of Sample Street immediately east of Webster Street and <br />extending along and to the rear of the Penn Central Railroad tracks (more particularly <br />described in a map attached to said petition); and <br />WHEREAS, inspections of the property have been completed by the Environmental <br />Protection Office and theFire Prevention Bureau; petitioner has agreed to conform with <br />all of the rules and regulations pertaining to the operation of such scrap yards; and <br />the Board of Public Works has approved the issuance of said license, all as required in <br />finance No. 6621 -79. <br />NOW, THEREFORE, BE IT RESOLVED by the CommonCouncil of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. That the license application for Bremen Iron and Metal Company, Inc., <br />for the operation of a scrap yard at the above location be approved, and the City Con- <br />troller authorized to issue such license, however, said license shall be subject to the <br />following conditions: <br />1 <br />f <br />1 <br />
