15 <br />EXHIBIT C <br />Description of Local Public Improvements <br />The Commission will complete, or cause to be completed, the following Local Public <br />Improvements in accordance with the terms and conditions of this Agreement and in compliance <br />with all applicable laws and regulations: <br />•Installation of new public water utilities; and <br />•Installation of new stormwater and sewer utilities; and <br />•Construction of street infrastructure to serve the project site. <br />It is understood between the Parties that the Commission’s financial contribution toward <br />the Local Public Improvements shall be limited to the actual documented costs incurred <br />for such Local Public Improvements, in an amount not to exceed the Funding Amount <br />specified in Section 1.3 of this Agreement. The Commission shall have no obligation to <br />expend the full Funding Amount. The Developer shall have the sole responsibility to fund <br />any and all costs associated with Local Public Improvements that exceeds this the Funding <br />Amount, as well as any costs associated with improvements not explicitly described in this <br />Exhibit C.
