REGULAR MEETING MAY 131 1985 <br />WHEREAS, the Common Council of the City of South Bend, Indiana, is very much aware of <br />the public concerns being voiced about current noise and odor problems of the ethanol <br />plant; and <br />WHEREAS, the Council is also very concerned that the New Energy Corporation be given <br />adequate time to investigate and implement changes which are deemed necessary to correct <br />their current problems; and <br />WHEREAS, because the Council believes that the City must strike a reasonable balance <br />between the concerns of our citizens and those of the economic and business community in <br />order that continued progress be made in our City; and <br />WHEREAS, the Council recognizes that the ultimate authority in this area rests with <br />the City administration, and therefore encourages it to cooperate with the Council and <br />the Technical Committee so that it will provide the leadership necessary to amicably <br />resolve the current noise and odor problems of the ethanol plant in a timely manner; and <br />WHEREAS, The Council ultimately believes that through the spirit of cooperation, the <br />City Administration will be able to protect our high quality of life and encourage the <br />New Energy Corporation to take all steps necessary to resolve their noise and odor <br />problems. <br />NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. The Common Council urges the City Administration to continue to work <br />through the Mayor's Technical Committee to timely resolve the current noise and odor <br />problems of the ethanol plant. <br />SECTION II. Since the Council realizes that the ultimate authority in this area <br />rests with the City Administration, it requests that in the event that the problems are <br />not resolved, that it investigate what legal action may be most appropriate in order to <br />protect the high quality of life in our community. <br />SECTION III. The Council urges the City Administration to keep the Council advised <br />on a regular and consistent basis of all major issues and of the timetable it believes is <br />most reasonable to correct these problems. <br />SECTION IV. Council Member Beck read the <br />resolution. Marty Steinhofer, 725 Fairway, spoke in favor of this resolution. Council <br />Member Zakrzewski indicated he could not support this resolution, because there is no <br />date for a solution of the problem. Council Member Taylor made a motion to adopt the <br />resolution, seconded by Council Member Serge. The resolution was adopted by a roll call <br />vote of eight ayes and one nay (Council Member Zakrzewski.), <br />BILLS, SECOND READING <br />BILL NO. 43 -85 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE <br />SOUTHEAST CORNER OF THE TOPSFIELD CONDOMINIUM PROJECT IN THE CITY OF <br />SOUTH BEND, INDIANA. <br />This bill had first reading. Council Member Serge made a motion to set this bill for <br />second reading and public hearing May 28, and refer it to the Zoning and Vacation <br />Committee, seconded by Council Member Braboy. The motion carried. <br />BILL NO. 44 -85 FIRST READING ON A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY <br />LOCATED AT 3310 HEPLER STREET IN THE CITY OF SOUTH BEND, INDIANA. <br />This bill had first reading. Council Member Voorde made a motion to refer this bill to <br />Area Plan, seconded by Council Member Crone.
