Contra ctor agrees that he/sh e/it shal l enr oll in and verify the work eligibility status of all of Contractor's
<br />newly hired employees thro ugh the E-Verify Pro gra m as defined by 1.C. 22-5-1.7-3. Contractor's
<br />documentation of enro llment and participation in the E-Verify Pro gra m is included and attached as part of
<br />this bid/quote; and
<br />5. Contractor shall require his/her/its subcontractors perfo rming work under this public contract to
<br />certify that the subcontra ctors do not knowingly employ or contra ct with an unauthorized alien, nor retain
<br />any employee or contract with a person that the subcontra ctor subsequently learn s is an unauthorized alien,
<br />and that the subcontra ctor has enr olled in and is participating in the E-Verify Pro gra m. The Contra ctor agrees
<br />to maintain this certification thro ughout the term of the contract with the City of South Bend, and understands
<br />that the City may terminate the contra ct fo r default if the Contra ctor fa ils to cure a breach of this pro vision
<br />no later than thirty (30) days after being notified by the City.
<br />6. Persons, fir ms, partnerships, corpora tions, associations, or joint venturers awarded a contra ct by the
<br />City of South Bend thro ugh its agencies, boards, or commissions shall not discrim inate against any employee
<br />or applicant for employment in the perfo rmance of a City contra ct with respect to hire, tenure, terms,
<br />conditions, or privileges of contra ct or employment, or any matter directly or indirectly related to contra cting
<br />or employment because of race, sex, religion, color, national origin, ancestry, gender expression, gender
<br />identity, sexual orientation, or due to age or disability that does not affect that person's ability to perfo rm the
<br />work.
<br />In awarding contracts fo r the purchase of work, labor, services, supplies, equipment, materials, or any
<br />combination of the fo regoing including, but not limited to, public works contra cts awarded under public
<br />bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards,
<br />or commissions will consider the Contra ctor's good faith effo rts to obtain participation by those
<br />subcontra ctors certified by the State of Indiana as a M inority Business ("M BE") or as a W omen's Business
<br />En terprise (WB E ") as a factor in determining the lowest, responsible, responsive bidder.
<br />Contra ctors seeking the award of a City contra ct cannot be required to award a subcontract to an M W BE;
<br />however, they may not unlawfu lly discriminate against said M BE/W BE. On goal-eligible contra cts,
<br />Contra ctors are required to either meet both MBE an d W BE utilization goals or demonstrate that the
<br />Contra ctor has made good faith efforts to obtain participation from M BE and W BE subcontractors. A finding
<br />of noncompliance or a discriminatory practice shall pro hibit that Contra ctor from being awarded a City
<br />contra ct for a period of one (I) year from the date of such determination, and such determination may also
<br />be gro unds for terminating the contact to which the discriminatory pra ctice or noncompliance pertains.
