LEGAL DEPARTMENT <br />INTEROFFICE MEMORANDUM <br />TO: Board of Public Works <br />FROM: Thomas L. Bodnar 1� t <br />Assistant City Attorney <br />RE: Lot Next to 225 Donald Street <br />DATE: August 15, 2006 <br />IC 36-1-11-5 sets forth the procedures involving the sale of property to abutting <br />landowners. In accordance with that statute, we have advertised for bids and only one bid <br />was received. <br />A key factor in the procedure to be used is based upon the assessed value. If it is <br />less than $6,000, no appraisal is necessary. As an adjacent landowner, Mr. West is <br />eligible. We can either sell it to him for $500 or attempt to conduct further negotiations. <br />If there has not already been such a determination of record, we need to make a <br />determination under IC 36-1-11-5(d) that: <br />1. The highest and best use of the tract is sale to an abutting landowner; <br />2. The cost to the public of maintaining the tract equals or exceeds the <br />estimated fair market value of the tract; or <br />3. It is economically unjustifiable to sell the tract. IC 36-1-11-4. <br />
