Section IIC11. Through mistake and inadvertence the established public utility easement on the West side of Lot 165, Scottsdale Addition, Section "C11, was slightly encroached upon by the residence con- structed thereon. This was not discovered until after such building had been fully and finally completed. An investigation discloses that you have not to date put the property sought to be released to use. In order to put Place and Company, Inc. in a position to complete this transaction and avoid substantial damage and injury, I would be most grateful if you would consider executing and returning to me the enclosed partial release of easement.
