<br />In consideration; of the sum of ten ($10.00)---------- Dollars cash in hand paid, receipt
<br />whereof is hereby acknowledged, the undersigned hereby grant, bargain, convey, transfer, deliver
<br />unto the Civil City of South Bend, a PERPETUAL 20 FT. WIDE STORM SEWER EASEMENT,
<br />for the following purposes namely: The right to enter upon the hereinafter described land to install,
<br />construct, operate, maintain, adjust, replace, repair, alter, remove, modernize said storm sewer
<br />system and related facilities, as may be necessary, on, over, and across the ground embraced within
<br />the PERPETUAL 20 FT. WIDE STORM SEWER EASEMENT hereinafter described, and as
<br />shown on attached EXHIBIT "A", "EASEMENT DIAGRAM", which is located within the
<br />boundaries of a tract or parcel of land situated in the County of St. Joseph, State of Indiana, briefly
<br />described as follows:

<br />COMMENCING AT THE SOUTHWEST CORNER OF LOT 1 AS SHOWN ON THE PLAT OF VIRIDIAN DRIVE
<br />MINOR SUBDIVISION, RECORDED MARCH 17, 2000 AS DOCUMENT #0013463 IN THE OFFICE OF THE
<br />RECORDER OF ST. JOSEPH COUNTY; THENCE N 90°00'00" E, FOR A DISTANCE OF 268.27 FEET ALONG
<br />THE NORTH RIGHT-OF-WAY OF VIRIDIAN DRIVE; THENCE CONTINUING ALONG SAID NORTH RIGHT-

<br />SOUTHERN LINE N 69021'01" E, FOR A DISTANCE OF 22.60 FEET, THENCE S 07-0616" W, FOR A DISTANCE
<br />OF 132.56 FEET; THENCE S 08°56'05" W, FOR A DISTANCE OF 135.67 FEET TO THE NORTH RIGHT OF WAY
<br />LINE OF VIRIDIAN DRIVE; THENCE ALONG AN ARC TO THE LEFT WITH A RADIUS OF 586.97 FEET AND
<br />A LENGTH OF 20.06 FEET, SUBTENDED BY A CHORD BEARING OF N 85031'59" W AND A CHORD LENGTH

<br />And the said Grantors hereby warrant to the Civil City of South Bend, Indiana, that they are
<br />lawfully seized and possessed of the afore described tract or parcel of land; that they have a good
<br />and lawful right to convey said Temporary Easement; that it is free from all encumbrances other
<br />than shown on said Easement Diagram; and that they will warrant and defend the title in quiet
<br />possession thereto against the lawful claims, of all persons whomsoever for the life of said
<br />Temporary Easement.
<br />And as a further consideration for the dedication of said Perpetual 20 ft. Wide Storm Sewer
<br />Easement, above stated, the Grantors hereby release all claims for damage, from whatsoever cause,
<br />incidental to the exercise of any of the rights herein granted, except for repair and replacement of
<br />any damaged existing utility infrastructure or building, whether public or private, to the same
