• 60% of the territory is subdivided; or <br />• the area is zoned for commercial, business or industrial uses. <br />2. Annexation Option 2 <br />The territory must be 1/4 (25%) contiguous to the boundaries of South Bend, <br />and the territory must be needed and can be used by South Bend for its <br />development in the reasonably near future. <br />3. Fiscal and Policy Plan <br />Both options also require South Bend to adopt, by resolution, a written fiscal <br />and policy plan. This plan must include all of the following: <br />• the cost estimate of planned services to be furnished to the territory; <br />• the method of financing the services; <br />• the plan for the organization and extension of services; <br />• the provision of non -capital services to be provided to the annexed <br />territory within one (1) year after the effective date of annexation, and <br />that they be provided in a manner that is equivalent in standard and <br />scope to those non -capital services currently being provided to areas <br />within South Bend of similar topography, patterns of land use, and <br />population density; <br />• The provision of capital improvements to be provided to the <br />annexed territory within three Q) years after the effective date of <br />annexation, in the same manner as those improvements are <br />provided to areas within South Bend that have similar topography, <br />patterns of land use and population density, and in a manner <br />consistent with federal, state and local laws, procedures and planning <br />criteria; and, <br />• the plan for hiring the employees of other governmental entities <br />whose jobs will be eliminated by the annexation, although the City is <br />not required to hire any employees, <br />F. PAYMENT OF DEBTS <br />When South Bend annexes any territory from a township which is indebted or <br />has outstanding unpaid bonds or other obligations at the time of annexation of <br />such territory, then the City shall be liable for and pay as much of such indebted- <br />16 <br />
