SECTION II. This Resolution shall be in full force and effect from and after <br />its & option by the Common Council and approval by the Mayor. <br />/s /Joseph T. Serge <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Patricia DeClercq, <br />Director of Code Enforcement, indicated the Board's approval of this license is <br />subject to the terms and conditions of an October 29, letter of commitment from the <br />applicant wherein he stated that he has reduced the number of employees on the <br />premises to one (1), thereby bring his parking facility into compliance with the <br />City ordinance; he will seed or sod the tree law area in front of the scrap yard as <br />early next spring as the weather permits; and he will remove the trailer from the <br />premises within thirty (30) days of the date of the letter. She indicated the <br />premises were inspected for fire code violations, environmental violations, proper <br />maintenance of the premises and area outside the fenced -in areas. Phillip Smith, <br />owner of the scrap yard, asked that the Council allow him to reopen. He indicated <br />the yard had been shut down since September. Chuck Rhoades, 625 Clearview, spoke in <br />favor of this license. Hildy Zemlyak, 1903 Franklin, Vice President of the Rum <br />Village Neighborhood Association, indicated this yard remained in violation of city <br />ordinances, as he does not have any toilet facilities and he keeps this business <br />records at home instead of at the business as required. Sylvester Gerschoffer, <br />president of the Rum Village Association, indicated if the laws were enforced they <br />would not have to be here fighting this license. Council Member Taylor made a <br />motion to adopt this resolution, seconded by Council Member Puzzello. The <br />resolution was adopted by a roll call vote of seven ayes and two nays (Council <br />Members Paszek and Voorde.) <br />BILLS. FIRST READING <br />BILL NO. 109 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: A <br />PERPENDICULAR ALLEY RUNNING NORTH AND SOUTH PARALLEL TO FOREST <br />AVENUE BEHIND LOTS 37 AND 38 PLAT OF CHAPIN PLACE BY EDWARD P. <br />CHAPIN. <br />This bill had first reading. Council Member Beck made a motion to set this bill for <br />second reading and public hearing November 23, and refer it to the Zoning and <br />Vacation Committee, seconded by Council Member Puzzello. The motion carried. <br />BILL NO. 110 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE <br />INTERSECTION OF PORTAGE AND CLEVELAND ROADS, IN THE CITY OF SOUTH <br />BEND, INDIANA. <br />This bill had first reading. Council Member Puzzello made a motion to refer this <br />bill to Area Plan, seconded by Council Member Beck. The motion carried. <br />BILL NO. 111 -87 A BILL APPROPRIATING FUNDS IN THE AMOUNT OF $57,560.00 FROM FUND <br />3288 EMERGENCY MEDICAL SERVICES CAPITAL IMPROVEMENT FUNDS. <br />This bill had first reading. Council Member Puzzello made a motion to set this bill <br />for second reading and public hearing November 23, and refer it to the Public Safety <br />Committee, seconded by Council Member Beck. The motion carried. <br />BILL NO. 112 -87 A BILL APPROPRIATING $17,500.00 FROM FUND #288 EMERGENCY MEDICAL <br />SERVICE CAPITAL IMPROVEMENT FUND TO DEFRAY EMS RELATED EXPENSES. <br />This bill had first reading. Council Member Puzzello made a motion to set this bill <br />for second reading and public hearing November 23, and refer it to the Public Safety <br />Committee, seconded by Council Member Beck. The motion carried. <br />BILL NO. 113 -87 A BILL TRANSFERRING $80,000 AMONG VARIOUS ACCOUNTS WITHIN THE <br />DEPARTMENT OF ECONOMIC DEVELOPMENT. <br />This bill had first reading. Council Member Braboy made a motion to set this bill <br />for second reading and public hearing November 23, and refer it to the Human <br />Resources Committee, seconded by Council Member Beck.
