SECTION I. That the Mayor of the City of South Bend, Indiana is hereby <br />authorized to submit the 1988 Community Development Block Grant Application to the <br />United States Government under Title I of the Housing and Community Development Act <br />of 1974, as amended. <br />SECTION II. That the Common Council of the City of South Bend, Indiana hereby <br />requests that the Mayor submit the 1988 Community Development Block Grant <br />Application to the Common Council for review and comment prior to the date upon <br />which the Community Development Block Grant Application must be filed with the <br />Department of Housing and Urban Development. <br />SECTION III. That for every activity, project, or program to be funded under <br />this Resolution, the Mayor shall submit to the Common Council an appropriation <br />ordinance prior to expenditure of any Community Development Block Grant funds <br />received upon approval of this application. <br />SECTION IV. That this Resolution shall be in full force and effect from and <br />after its adoption by the Common Council and approval by the Mayor. <br />/S /Joseph T. Elizabeth Leonard, <br />Director of Financial and Program Management, indicated this resolution authorizes <br />the Mayor to submit the City's 1988 application for Community Development Block <br />Grant funds. Council Member Taylor made a motion to adopt this resolution, seconded <br />by Council Member Beck. The resolution was adopted by a roll call vote of eight <br />ayes. <br />Council Member Taylor made a motion to suspend the rules for purposes of filing a <br />resolution and have public hearing on the resolution, seconded by Council Member <br />Beck. The motion carried on a roll call vote of eight ayes. <br />RESOLUTION NO. 1538 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA APPROVING A PETITION FOR AN EXCESS LEVY <br />OF THREE CENTS PER ONE HUNDRED DOLLARS OF ASSESSED <br />VALUATION AS PERMITTED PURSUANT TO I.C. 6 -1.1- 18.5 -13. <br />WHEREAS, the Common Council recognizes that I.C. 6 -1.1- 18.5 -13, permits a civil <br />taxing unit to increase its levy on property at a tax rate of three cents (0.03) per <br />one hundred dollars ($100.00) of assessed valuation; <br />WHEREAS, the Council further recognizes that TRANSPO is facing a budget deficit <br />due to a substantial decrease in federal operating assistance; <br />WHEREAS, the additional funding would assist in balancing TRANSPO's budget and <br />would assist them in the retention of current services used by the youth, the <br />disabled, and low income and senior citizens of our community who use TRANSPO as <br />their only transportation to work, school, and medical services; <br />WHEREAS, the initial step in the State law procedure is for the Common Council <br />to adopt a resolution approving said increase with the second step being the local <br />government tax control board approving it based upon providing adequate <br />transportation services to the area. <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. The Common Council of the City of South Bend, hereby approves a <br />petition for an excess levy of three cents per one hundred dollars of assessed <br />valuation as permitted pursuant to I.C. 6 -1.1- 18.5 -13. <br />SECTION II. This resolution shall be in full force and effect from and after <br />its adoption by the common council and approval by the Mayor. <br />/S/ John Voorde <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Michael Vance, 1310 <br />Mishawaka Ave., (Council's appointment to the TRANSPO Board) indicated the bus <br />company has experienced a reduction in ridership as well as a decrease in federal <br />funding in recent years. He indicated that the Board passed a deficit budget for <br />1988 in anticipation of the tax rate increase being approved. He indicated that the <br />tax rate of 3 cents per $100 of assessed valuation will apply in both South Bend and <br />Mishawaka. He indicated that this will have to go to the State Board of Tax <br />Commissioners for their approval. Joseph Guentert, 3510 Corby, spoke against this <br />resolution. Council Member Beck made a motion to adopt the resolution, seconded by <br />Council Member Taylor. The resolution was adopted by a roll call vote of six ayes <br />and two nays (Council Members Zakrzewski and Barcome.) <br />BILLS, FIRST READING <br />
