WHEREAS, I.C. 36- 9 -11 -4 further provides that on the basis of such surveys and <br />studies, recommendations shall be made to the Board of Public Safety and the Common <br />Council concerning the general location, size, and character of and probable cost of <br />acquiring and developing needed parking facilities; and <br />WHEREAS, the South Bend Common Council has had presented to it at its regular <br />meeting of September 14, 1987, information from surveys and studies conducted by the <br />South Bend Department of Economic Development and the Michiana Area Council of <br />Governments concerning the need for and proper location of parking facilities in the <br />central downtown area of the City of South Bend; and <br />WHEREAS, those surveys and studies gave due consideration to the free and safe <br />movement of traffic, the terminal points and concentration of traffic, and the <br />adequacy of privately owned parking lots or structures, as well as the adequacy of <br />publicly owned parking lots or structures; and <br />WHEREAS, the South Bend Common Council had duly considered information from <br />surveys and studies conducted by the South Bend Department of Economic Development <br />and the Michiana Area Council of Governments concerning the need for and proper <br />location of parking facilities in the central downtown area of the City of South <br />Bend; and <br />WHEREAS, at its regular meeting held September 9, 1987, the South Bend Board of <br />Public Safety adopted a resolution approving recommendations of the South Bend <br />Department of Economic Development and the Michiana Area Council of Governments <br />concerning the general location, size, character of, and probable cost of acquiring <br />and developing a certain needed parking facility in the central downtown area of the <br />City of South Bend; and <br />WHEREAS, the South Bend Board of Public Safety has submitted those <br />recommendations to the South Bend Common Council for acceptance or rejection <br />pursuant to I.C. 36- 9 -11 -4; and <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Common Council as follows: <br />Section 1. The recommendation of the South Bend Board of Public Safety that a <br />parking structure be constructed at the northwest corner of East Wayne Street and <br />South St. Joseph Street in the central downtown area of the City of South Bend, with <br />construction to begin in early 1988, and the parking structure consisting of <br />approximately 440 parking spaces is hereby accepted and approved. <br />Section 2. The recommendation of the South Bend Board of Public Safety that the <br />parking structure described in paragraph 1 hereof be acquired and developed pursuant <br />to the design recommendations of Walker Parking Consultants, Inc., at a cost of <br />approximately $3,600,000, is hereby accepted and approved. <br />Section 3. The South Bend Board of Public Works is hereby authorized to proceed <br />as provided by I.C. 36- 9 -11 -1, et seq. in accordance with this resolution. <br />Section 4. Pursuant to I.C. 36- 9- 11 -8(d) the South Bend Board of Public Works <br />is hereby authorized to use for the parking structures pursuant to this resolution <br />land previously acquired by the South Bend Redevelopment Commission, not needed for <br />other purposes, located on the northwest corner of East Wayne Street and South St. <br />Joseph Street, more particularly described as follows: <br />A part of the Northwest Quarter of Section 12, Township 37 North, Range 2 East <br />of the Second Principal Meridian, Portage Township, City of South Bend, Indiana <br />being a part of Lots Fifty (50), and Fifty -one (51) and Fifty -two (52) of the <br />Original Plat of South Bend, Indiana more particularly described as follows: <br />Beginning at the intersection of the Westerly right -of -way line of St. Joseph <br />Street (85 foot right -of -way) with the North right -of -way line of Wayne Street <br />(82.5 foot right -of -way), thence South 038112" West (bearing assumed) along <br />the North right -of -way line of Wayne Street 148.84 feet; thence North <br />00037100" West, 186.00 feet; thence North 89039134" East, 165.61 feet; <br />thence Southwesterly 186.99 feet along a segment of a curve to the right having <br />a radius of 912.43 feet, subtended by a chord having a bearing of South <br />04042119" West and a length of 186.66 feet to the point of beginning. <br />Section 5. This resolution shall be in full force and effect from and after its <br />passage by the Common Council and approval by the Mayor. <br />/s/ Joseph T. Jon Hunt, Director of <br />Redevelopment, indicated there is a need for more parking in the central downtown <br />area. He indicated they were proposing a 440 space garage to be constructed at the <br />northwest corner of Wayne and St. Joseph streets. He indicated it would be a six <br />story parking garage with a glass backed elevator. He indicated the garage would be <br />paid for from garage user fees, tax incremental financing and the repayment of a <br />$2.5 million federal Urban Action Development Grant. He indicated the garage would <br />cost approximately $3.6 million. Joseph Guentert, 3510 Corby and Irene Mutzl, 320 <br />
